Re: Follow Up of Public Records Request Dated March 2, 2013
The Town of Gulf Stream has received an email from you, dated March
2, 2013 (attached). On March 5, 2013 the Town sent you a response
via fax (attached). We received no further correspondence from you
indicating that our response was not sufficient.
To the extent this email requests information about our Town Code
and Sec. 66 -446, please see a copy of that Section of the Code. The
Public Records law does not require the Town to provide you with
answers to your legal questions. Nevertheless, we will continue to
work with you to provide you with access to our copies of the
appropriate responsive documents, and we request that you clarify your
email to request specific documents.
Should you need anything further, please let us know.

Hi Bill - thank you for your email below. I would appreciate your indulgence in connection with a
few more questions, which I request that you respond to in your official capacity.
As to your #1 below, I raise the following:
1 The Code states your duties, could you provide me the Section which deals with your duties
regarding signs?
2 Does #1 below represent your interpretation of the code regarding signs with Street names
and numbers?
3 Although I could certainly understand why you would want to consult the Town Solicitor in
connection with my inquiry, I am befuddled as to why the Mayor would be consulted.
Kindly advise, as I see no such provision in the Code for the Mayor to unilaterally make any
decisions or recommendations regarding the Code or any potion thereof.
4 Please advise if a sign is a "Structure" under the Code. In this connection , a "Structure" is
defined in the Code as: that which is built or constructed,...or any piece of wok artificially
built up or composed of parts joined together in some manner. The term "Structure" shall
be construed as if followed by the words "or part of ".
5 Please advise if a Permit is required for the construction of signs pursuant to Code Section
66- 446(a)(4) or any other subsection of 66 -446 (advising of the subsection and the relevant
language imposing the requirement).
6. In reviewing Code Section 66- 446(a)(4), I see no limitation on the # of signs permitted.
Please confirm that there is no limitation, since the "code language does not require any
limitation on the number of signs permitted pursuant to Code Section 66- 446(a)(4)"
7 Based on my reading of 66- 446(a)(4), if (and only if) you are the owner of private property
may you erect a sign identifying their name or ownership, entrance, and exit roads and
street number IDENTIFYING SUCH PROPERTY. As I understand 66- 446(a)(4) and your #1
below where you say the "code language does not require that they be placed on private
property ". If that is so, that must mean that the signs may be erected anywhere and for
any property as long as the erector is an owner of private property. Although I think to
endorse such a meaning stretches credulity, alternatively, it could be (better) read to mean
that the words "identifying such property" limit the erection of the sign on the specific
property where the erector[s] is \are the owner of private property and the signs are
identifying the name or ownership, entrance, and exit roads and street numbers of the
private property owned by the erector; and which has the entrance and exit roads thereon.
Bill, which is right?
8 Do signs require any type of review (Level 1, 2 or 3)? If so, please point me to the relevant
Code Section [s]

3. Correction as follows: "After review and consultation with our attorney, and
informing the Mayor of the attorney's determination, I offer the following.... As
you know the Mayor or any other election official cannot unilaterally make
policy.

6. The limitation is to "a" sign.
7. I believe that in differencing situation either or could be correct.
