ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE
CITY CODE BY DELETING SECTIONS 32-53, 32-54, 32-60 AND 32-61 AND
ENACTING IN LIEU THEREOF 3 NEW SECTIONS PRESCRIBING AND FIXING
RATES AND CHARGES FOR THE USE OF PUBLIC SEWERS AND THE
SEWERAGE SYSTEM OF THE CITY OF JEFFERSON , MISSOURI.
WHEREAS, the City of Jefferson did accept various grants from the
United States Environmental Protection Agency (EPA) for the cost of
portions of the Jefferson City waste treatment works; and
WHEREAS, one of the conditions of the EPA grants requires that the
City of Jefferson adopt, implement, and maintain a user charge
system for the project as approved by the Regional Administrator of
the EPA; and
WHEREAS, the City of Jefferson did issue Revenue Bonds for the cost
of portions of the Jefferson City waste treatment works; and
WHEREAS, one of the conditions of the Revenue Bonds requires that
the City of Jefferson will fix and maintain rates and make and
collect charges for the service and facilities of the system sufficient
to provide for the payment of the principal of and the interest on the
bonds as they mature and accrue, and sufficient to provide for the
operation and maintenance of the system in good repair and working
order; and
WHEREAS, it is necessary to increase the rates and charges for the
services and facilities of the system in order to provide for the
payment of the principal of and the interest on the bonds and to
provide for the operation and maintenance of the system in good
repair and working order,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI , AS FOLLOWS:
Section 1. Chapter 32 of the City Code is hereby amended by
deleting Sections 32-53, 32-54, 32-60 and 32-61 and enacting in lieu
thereof 3 new sections, which shall read as follows:
Sec. 32-53. Sewer Service Charges; Applicability.
Sewer service charges are hereby levied against every
residential, commercial, industrial, and governmental
establishment connected to public sewers and against all such
establishments which are not connected to public sewers but for
which sewer service is available. Sewer service shall be
considered available if a sewer, which ultimately discharges
into the City treatment works, is within 150 feet of any part of
the property on which a residential, commercial , industrial, or
governmental establishment exists. The proceeds of such charges
so derived will be used for the purpose of operating,
maintaining and replacing the sewer system and equipment and
for the purpose of retiring; the debt for the public wastewater
treatment works.
Sec. 32-54. Sewer Service Charges; Rates.
(a) All residential, commercial, industrial and governmental
establishments shall be charged for sewer service in accordance
with the following rate table. The sewer service charge shall
consist of a monthly fixed minimum charge plus a charge based
upon the cubic feet of water used per month. The charges shall
become effective on the dates listed in the table, and shall be
applicable through the subsequent year. The rate effective on
November 1 , 1987 shall be effective thereafter until changed.

(b) Every sewer service charge specified in this section
remaining unpaid for 40 days after the date of its billing may
be increased by 10%, and thereafter such sewer service charge
may be increased an additional 10% for each 30 day period such
charge remains unpaid after the expiration of 40 days from the
date of its billing.
(c) A surcharge rate is established for any wastewater
discharged into the City treatment works which contains more
than three hundred milligrams per liter (300 mg/1) of suspended
solids (SS) , or more than two hundred fifty milligrams per
litter (250 mg/1) biochemical oxygen demand (BOD) as defined
and determined by analytical methods published in Standard
Methods for the Examination of Water and Wastewater.
Surcharges for suspended solids SS and biochemical oxygen
demand ( BOD) shall be paid at the rates established in Rate
Table I1 , and shall be paid in addition to the normally
established rates listed in Rate Table 1. The charges shall
become effective on the dates listed in the table, and shall be
applicable through the subsequent year. The rate effective on
November 1 , 1987 shall be effective thereafter until changed.

Sec. 32-61. Sewer Service Charges; Revision of Rates.
The City shall review annually the schedules of rates for sewer
service charges, and revise the rates, if necessary, to generate
adequate revenues to pay the costs of operation and
maintenance, to promptly pay the principal of, and interest on
all bonds issued by the City which by their terms are payable
solely from the revenues of the treatment works, and to
maintain any special accounts created and established by the
bond ordinance pursuant to which the bonds are issued.
Section 2. This Ordinance shall be in full force and effect from
and after its passage and approval.
