AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, GRANTING AN EASEMENT AND DECLARING REAL PROPERTY TO BE SURPLUS, AUTHORIZING ITS SALE AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE A DEED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized to execute an easement to Cole County Abstract, Realty & Insurance Company for keeping and maintaining a drain pipe over a portion of property lying between the presently existing building at 240 E. High Street and the south property line thereof. The easement shall be substantially the same in form and content as the exhibit attached hereto as Exhibit A. Section 2. The City Council finds that the following real property is surplus property of the City, and as such represents a burdensome cost, and., that the property is no longer needed for any public purpose: Part of Inlot 479, in the City of Jefferson, County of Cole, Missouri, more particularly described as follows: From the northeasterly corner of said Inlot 479; thence southerly along the easterly line thereof (westerly line of Monroe Street) 100.00 feet, to the beginning point for this description; thence deflecting 890 08' to the right, for a distance of 44.38 feet; thence southerly parallel to the easterly line of said Inlot 479, 2.39 feet; thence deflecting 900 53' to the left, for a distance of 44.38 feet; thence northerly along the easterly line of Inlot 479, 2.38 feet to the point of beginning. Section 3. The Mayor and City Clerk are hereby authorized to sell the property to David N. Herman, Inc. for the sum of $1 .00 as part of the sale authorized by Section 2 of Ordinance No. 10077. Section 4. The Mayor and City Clerk are hereby authorized to execute a quit-claim deed relinquishing all of the City's interest in the tract of ground described in Section 2. Section 5. This Ordinance shall be in full force and effect from and after its passage and approval. Passed 11 - 7- 8 .3 Approved 1/ - 9- 83 c 24fi- Preeding Officgf MAYOR ATTEST: City Clerk E IXff181T EASEMENT �- This Agreement is entered into on 'the day of November, 19 , by and between the City of Jefferson, Missouri, hereinafter referred to as "City", 'and Cole County Abstract, Realty & Insurance Company, hereinafter referred to as "Company." In consideration of the mutual covenants and grants contained herein, the parties agree as follows: I. Company does hereby grant to the City an easement over a portion of its property, :located at X06 .Monroe Street . in Jeff e.rson..City, Missouri, which portion of property ' lies ­ between the presently existing building and the north property line. The easement is for the purpose of allowing the City to keep and maintain on the easement a portion of the fire escape which is presently attached to the City's building at 240 E. High Street. The easement shall remain in effect as long as the building currently located at 240 E. High remains in existence. If that building is ever removed, then this easement shall cease. 2. City does hereby grant to the Company an easement over a portion of its property, located at 240 E. High Street in Jefferson City, Missouri, which portion of property lies between the presently existing building and the south property line. The easement is for the purpose of allowing the Company to keep and maintain on the easement a drain pipe which is presently attached to the Company's building at 306 Monroe Street. The easement shall remain in effect as long as the building currently located at 306 Monroe Street remains in existence. If that building is ever removed, then this easement shall cease. 3. These easements and covenants herein contained shall run with the land and inure to and be binding upon the successors in title of the respective parties. CITY OF JEFFERSON,.
