AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AMENDING ORDINANCE NO. 9598 AND CHAPTER 36 OF THE CODE OF THE CITY OF JEFFERSON, THE ZONING ORDINANCE, BY ENACTING A NEW SECTION 6.C. (2) RELATING TO EXCEPTIONS TO YARD REQUIREMENTS AND BY REPEALING SECTION 10.B.(3) RELATING TO THE DISCONTINUANCE OF NON-CONFORMING USES AND ENACTING A NEW SECTION 10.B.(3) IN LIEU THEREOF. WHEREAS IT APPEARS THAT THE PROCEDURES SET FORTH IN CHAPTER 36 RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Ordinance Number 9598, enacted as Chapter 36, the Zoning Ordinance is hereby amended by renumbering subsections 6.C. (2) through 6.C. (10) as subsections 6.C.(3) through 6.C. (11 ) . Section 2. Ordinance No. 9598, enacted as Chapter 36, the Zoning Ordinance, is hereby amended by adding a new Section 6.C. (2) to read as follows: (2) If 40% or more of a frontage is occupied by two or more buildings, then the minimum width of a side yard in the R Districts - Residential is established in the following manner: (a) The minimum side yard width is and remains an average of the then existing side yards included in a frontage, provided however, existing side yards having a width greater than ten (10' ) feet shall be deemed to have a width of ten (10' ) feet for purposes of computing the average. Side yards for vacant lots shall not be included in computing the average. (b) If the computed average side yard is less than ten (10' ) feet, and the existing side yard of the applicant's building is less than ten (10' ) feet, an existing building may be enlarged provided that front and rear yard requirements are observed and the widths of the existing side yards of the applicant's building are not diminished. Section 3. Ordinance No. 9598, enacted as Chapter 36, the Zoning Ordinance, is hereby amended by deleting Section 10.B. (3) and enacting in lieu thereof a new section, to read as follows: (3) Discontinuance of Non-Conforming Uses. No building or portion thereof used in whole or in part for a non-conforming use in any district, which remains idle or unused for a continuous period of nine (9) months, whether or not the equipment or fixtures are removed, shall again be used except in conformity with the regulations of the District in which it is located.
