ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH BLACK &
VEATCH FOR THE PERFORMANCE OF A STORM DRAINAGE MANAGEMENT
STUDY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and Clerk are hereby authorized and
directed to execute a contract with Black & Veatch for the
performance of a storm drainage management study for the sum of
$166,200.
Section 2. The contract shall be substantially the same in form
and content as that contract attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from
and after the date of its passage and approval.

CONTRACT FOR ENGINEERING SERVICES
THIS CO TRACT, made and executed in duplicate this day of
_, 1984, by and between the City of Jefferson City,
Missou , hereinafter called the City, and Black & Veatch, Engineers-
Architects, hereinafter called the Engineer;
WITNESSETH: That in consideration of the mutual covenants herein contained,
the City hereby agrees to employ the Engineer to perform the services
hereinafter outlined in connection with a storm drainage management study
and report, and agrees to pay the Engineer for such services according to
the manner and schedule of compensation herein contained.
SECTION I - SCOPE OF SERVICES
The Engineer agrees to perform engineering services for the project including
preliminary investigations; engineering study of storm drainage facilities
and management; field surveys as needed and facilities inventory and evalu-
ation; financial studies of funding alternatives for capital improvements
and operation and maintenance; and supplemental services as requested.
Description of the services to be performed is listed in Appendix A attached
to and made a part of this Contract. The Engineer will not perform said
services until notified to proceed by the Public Works Director of the City.
SECTION II COMPENSATION -
For the services covered by this contract, the City agrees to pay the
Engineer as follows:
A. For the services outlined in Appendix A, the City agrees to pay the
Engineer a fee computed on the basis of twice the payroll cost for
all of the Engineer's personnel, support personnel or local assistance
personnel engaged on the work, plus reimbursement of expenses directly
chargeable to the work as defined in Paragraph B. Payroll cost is
defined as direct salary cost plus 25 per cent. It is mutually
understood that the total maximum fee billing for services outlined
in Appendix A shall not exceed One Hundred Sixty-Six Thousand Two
Hundred Dollars ($166,200).
B. Reimbursable direct expenses chargeable to the project, which are
included in the maximum fee billing above, to the extent listed in
Appendix A as follows:
1. Travel, subsistence, and incidental costs.
2. Use of motor vehicles on a mileage or rental basis.
3. Telephone and telegraph costs.
® 4. Reproduction of reports and exhibits.
5. Postage and shipping charges for project related materials.

6. Computer time charges, including program use charges.
7. Rental charges for use of equipment, including equipment owned
by the Engineer, not included in overhead costs.
8. Cost of acquiring any other materials or services specifically
for and applicable only to this project, including preparing,
disseminating and evaluating questionnaires for locating and
identifying problem areas.
C. The following are reimbursable expenses that are not included in the
maximum fee billing amount stipulated above:
1. Charges of special consultants, except Central Missouri Professional
Services, Inc. who are included, requested or authorized by the
City.
2. Local taxes or fees applicable to the engineering work or payments
therefor.
D. Partial periodic monthly payments shall be made to the Engineer by
the City as follows:
I. The Engineer shall render an itemized monthly statement to the
City for work performed and costs incurred during the preceding
month.

2. The monthly installments and current total billings sha11 not be
disproportionate to work progress as reported by the Engineer.
3. The entire amount due shall be paid each month provided the
maximum billing amount has not been exceeded.
SECTION III - CITY'S RESPONSIBILITIES
The City will furnish, as required for the work and not at the expense of
the Engineer, the following items:
A. Property, boundary, easement, right-of-way, topographic, and utility
surveys and property descriptions when such information is required,
except that easement surveys and descriptions for the Debra Street
Specific Design Project shall be performed or prepared by the Engineer.
B. All maps, drawings, records, audits, annual reports, and other data
that are available in the files of the City and which may be useful
in the work involved under this Contract.
C. Access to public and private property, as necessary, when required to
conduct field investigations.
D. The services of at least one City employee who has knowledge of the
existing storm drainage system plus workmen and equipment as necessary
to gain access to manholes and special structures during the conduct
of field investigations.

E. Publicity for public' meetings and a revenue for these meetings.
F.. Releases to the news media explaining the progress and other desired
informational publicity regarding the study.
SECTION IV - OTHER MATTERS
It is mutually understood and agreed:
A. That reproducibles of tracings and maps prepared or obtained under
the terms of this Contract shall be delivered upon request to and
become the property of the City upon termination or completion of
the work. Copies of basic survey notes and sketches, charts,
computations and other data prepared or obtained under this Contract
shall be made available, upon request, to the City without restrictions
or limitations on their use. When such copies are requested, the City
agrees to pay the Engineer its cost of copying and delivering same.
B. The Engineer shall not-sublet, assign or transfer any interest in the
works covered by this Contract except with prior written consent of
the City. The use of subcontractors shall in no way relieve the
Engineer from his primary responsibility for the performance of the
work.
It is the intention of the Engineer to engage Central Missouri
Professional Services, Inc. as a subcontractor to assist in. field
surveys and facility inventories. If at any time, however, the
Engineer concludes that it would be in the best interests of the
City to change subcontractors or to change the amounts or types of
work to be subcontracted, the Engineer shall so notify the City in
writing giving reasons for the proposed changes. Upon written
consent of the City, the Engineer may then make such changes.
No approval will be required for non-professional services such as
reproduction, printing, materials and other services normally
performed or provided by others.
C. The City may cancel this 'Contract or any part thereof at any time
by giving written notice to the Engineer at least 15 calendar days
prior to. the effective date of the termination. The Engineer shall
be paid for the value of all acceptable work performed prior to the
effective date of termination based on the payment terms of the
Contract. Payment shall not exceed the total amount encumbered under
this Contract, except as may have been previously amended in accordance
with supplemental agreements.
It is not contemplated that the Engineer shall have any right of termi-
nation other than for such cause as has been established as sufficient
at law.

D. The Engineer agrees that he will comply with all Federal and State laws
and Federal regulations and directives pertaining to nondiscrimination
on the ground of race, color, or national origin in connection with
this Contract, including procurement of materials and lease of equipment.
E. The Engineer warrants that he has not employed or retained any company
or person, other than a bona fide employee working solely for the
Engineer, to solicit or secure this Contract, and that he has not paid
or agreed to pay any company or person, other than a bona fide employee
working solely for the Engineer, any fee, commission, percentage,
brokerage fee, gifts, or any other consideration, contingent upon or
resulting from the award or making of this Contract. For breach or
violation of this warranty, the City shall have the right to annul
this Contract without liability, or, in its discretion, to deduct from
the Contract price or consideration, or otherwise recover the full
amount of such fee, commission, percentage, brokerage fee, gifts, or
contingent fee.
F. The Engineer and all his subcontractors shall maintain all books,
documents, papers, accounting records and other evidence pertaining
to costs incurred in connection with this Contract, and shall make
such materials available at their respective offices at all reasonable
times during the Contract and for a period of three (3) years following
completion of the Contract.
G. That the Engineer shall not be liable for delays resulting from causes
beyond the reasonable control of the Engineer; that the Engineer has
made no warranties, expressed or implied, which_ are not expressly
set forth in this Contract; and that under no circumstances will the
Engineer be liable for indirect or consequential damages.
H. That the Engineer will perform any additional work requested by the
City which is not specifically covered in the scope of work as defined
herein at a reasonable-fee or compensation to be agreed to between
the City and the Engineer at the time any such service may be required.
I. The services provided for herein shall commence upon receipt of notice
to proceed from the City through its Director of Public Works. The
work shall be completed within twelve (12) calendar months following
" notice to proceed in writing, unless completion time is extended by
mutual agreement between the City and Engineer.
J. The following key personnel will be assigned by the Engineer to perform
the services covered by the Contract, along with necessary support
personnel and local assistance provided by Central Missouri Professional.

Project Engineer, K. A. Stumpf; Water Resources Specialist, Dr. R. E.
Filardi; Storm Water Design Manual, W. N. Limbrick; Financial and
Legal, R. D. Hardten; Alternative Modeling, K. E. Larson; Specific
Design, M. P. Schnieders; Planning, H. M. Lightle; Storm Water Ordi-
nance, D. R. Schapker; Operation and Maintenance, J. Boomhouwer.

APPENDIX A
TO
CONTRACT FOR ENGINEERING SERVICES
CITY OF JEFFERSON CITY, MISSOURI
STORM WATER MANAGEMENT PLAN
DESCRIPTION OF SCOPE OF WORK
Preliminary Investigations, Engineering Study, and Storm Water Management
Plan.
I. Necessary field studies and investigations will be undertaken.
The existing storm drainage system will be reviewed, inventoried,
and evaluated and problem areas will be identified.
2. Plan, profile and cross sections of existing major streams by
field survey and use of existing topographic maps as appropriate
for reasonable accuracy.
3. Plan, profile and evaluation of existing drainage facilities
as required to determine functional capabilities, capacities,
conditions and estimated life expectancies.
4. Topographic, geographic and geologic survey as pertains to soil
types, vegetation considerations., runoff and erosion relating
to structural stability.
5. Development survey as relates to land use and transportation net-
works to existing waterway characteristics. Review and document
proposed land use plans and public improvements to existing
system.
6. Future growth will be projected and future storm water flows
predicted. Consideration will be given to land use, drainage,
basin characteristics and project development.
7. Existing subdivision regulations and zoning and flood plain
ordinances will be reviewed and, if applicable, revisions
commensurate with current storm drainage management practices,
recommendations and specific design criteria will be recommended.
Requirements and guidelines for drainage plan preparation by
developers, for City review, will be outlined.
8. Opportunities for involvement and input from Public Works staff,
elected officials, concerned citizens and other interested indi-
viduals and groups will be -provided through scheduled meetings
throughout the duration of the study. Follow-up personal contact
will be provided with those identifying specific problems.

As a minimum, the Engineer will participate in the following
meetings:
A. One general public problem identification meeting in
each of the five (5) wards of the City.
B. One general public meeting to actively seek input
after the development of preliminary plans in each
of the five (5) wards.
C. Four (4) meetings on a quarterly basis to update and
seek input from the Public Works Committee.
• D. Twelve (12) meetings with Public Works staff for
monthly report.
E. Two (2) meetings with consultants, developers, and
realtors for development and finalization of design
criteria and storm water ordinance.
F. One (1) general public meeting to discuss funding
alternatives.
G. Two (2) meetings with the City Council to submit and
summarize final report.
Scheduling of meetings will be through the Director of Public
Works or his assigned staff member. _
9. Adequacy of the existing storm drainage system to meet present
and anticipated future flows will be reviewed and needed
improvements recommended. Where applicable, innovative storm
water attenuation methods such as retention in off-line basins,
pervious pavement, lot grading, and detention in storm drains
will be considered. -
10. Hydrologic and hydraulic analyses will be performed. Infor-
mation relating to precipitation intensity and frequency of
occurrences and other data, including field survey results,
will be analyzed and summarized for computer modeling and
engineering analysis. Black & Veatch will make frequent
status checks on the Corps of Engineers' current Wears Creek
watershed study progress to avoid duplication of effort. Full
use will be made of available data and analyses.-
11. Analysis with two computer models, ILLUDAS and HEC-2, will be
utilized for modeling existing and future conditions. The two
computer models will be incorporated into an analytical system
for the City's use in future planning and design. The model
software will be adapted to computer facilities of the City's
choice. Training in the use of the models will be provided to
City personnel.
• 12. Data and information compiled from surveys, meetings and
computer runs will be assessed to identify problem areas and
their relative magnitude, at which time a preliminary set of

alternatives will be developed. Results of computer modeling
will be interpreted and analyzed to assess the effectiveness
® of each alternative course of action. Results will be used to
refine or modify the most effective and cost-effective alter-
natives. The refined alternatives will be evaluated and the
overall best course of action will be selected as the master
plan of storm water management.
13. The best storm water management alternative selected as the
master plan will include:
A. A priority system to form the basis of staged construction
according to urgency of the problem and provide response
to citizens' inquiries.
B. All assumptions and design criteria used during the study
to calculate storm flows.
C. In the Appendix, the user manuals for the computer programs
and step-by-step procedures to enable the City's staff to
update the plan.
D. A cost, cost/benefit ratio, priority number and description
of each improvement.
E. A financial plan.
® F. An operation and maintenance program:
G. Description of the overall benefits, such as multi-use
purpose, recreation, etc. ,
H. A summary of public involvement documentation throughout
the project.
14. Funding analysis investigating possible methods of funding the
storm water improvements will be identifed and undertaken.
Funding mechanisms to be analyzed include bond issues, taxes,
user charges, and others such as special assessments, direct
charges and innovative financing techniques. Potential sources
include federal and state grants and Corps of Engineers parti-
cipation in projects for certain drainage basins.
15. Prepare a recommended operation and maintenance program for
the storm water management system, including recommendations
pertaining to maintenance of storm drains on private property
and discussion regarding contract maintenance.
Evaluate current staffing and make recommendations regarding
the organization, staffing and equipment of maintenance crews
under the recommended storm water management program.

Develop an operation and maintenance budget projected for a
five-year period with alternative methods for financing annual
® operation and maintenance expenses presented and evaluated.
16. Determine the feasibility of monitoring and recording rainfall
in the City. If found to be feasible, make recommendations
concerning the type of equipment, location and precipitation
data collection procedures.
17. Prepare a storm drainage ordinance to regulate and control the
drainage of storm water within the City limits. Recommendations
will be made for revising subdivision regulations and controls
to reflect the provisions of the storm drainage ordinance and
the storm drainage design manual. The City will be furnished
10 copies of the storm drainage ordinance in addition to any
that may be bound into other furnished documents.
18. Prepare a storm drainage design manual to establish uniform
design procedures for flood protection facilities; to help
reduce losses due to flooding; to control traffic flow dur_t.ng
storm events; and to facilitate review by City personnel of
storm drainage designs submitted by developercn;. The manual
will contain a section on drainage material specifications.
The City will be furnished 100 copies of the final design
manual.
® 19. To address the legal aspects of this projecL, Black & Veatch's
staff of attorneys and attorney/englileers will identify appli-.
cable federal., state ar_d local legal requirements through
review of the storm waLc! master plan and procedures, other
associated Cocuments and ordinance recommendations. Input and
comments will be solicited from the City's legal staff.
20. A final storm water management plan for collection, storage,
and conveyance of storm water originating in the planning area
will be produced. It will provide a precis of the findings
and recommendations in an executive summary; 100 copies will
be furnished to the City. Facilities maps on mylar at 200
scale will be furnished.
21. Perform all services requested in the City's "Scope of Services
for Storm Water Study and Master Plan" and the Black & Veatch
Proposal, dated October 14, 1983, for the Debra Street Specific
Design Project.
22. Prepare a *facilit{.es improvements map showing the recommended
improvements. The map will be used at the various public
meetings during the study and will be turned over to the City
at the completion of the study.
23. Prepare a slide presentation by end of study period for public
awareness indoctrination of storm water management needs.
