AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1065-06 AND THE FISCAL YEAR 2006-07 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 1065-06 on September 12, 2006, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2006-07; and WHEREAS, changed conditions resulted in the adoption of Ordinance No. 1073-06 on December 12, 2006; Ordinance No. 1083-07 on March 13, 2007; Ordinance No. 1084-07 on April 24, 2007 and Ordinance No. 1096-07 on August 14, 2007 amending the budget adopted by Ordinance No. 1065-06. WHEREAS, changed conditions and circumstances which could not have been foreseen through the use of reasonable diligent thought and attention, have necessitated a certain amendment to Ordinance No. 1065-06, and the budget adopted thereby; and WHEREAS, a public hearing on the following amendment to the fiscal year 2006-07 budget contemplated has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section II of said Ordinance No. 1065-06 as amended be amended appropriating $4,407,959 from the General Fund for Operating Expenses and Capital Outlays of the City Government as set forth in the budget. II. That Section III of said Ordinance No. 1065-06 as amended be amended appropriating $3,376,707 from the Enterprise Fund for Operating Expenses and Capital Outlays for Water and Sewer Works as set forth in the budget. III. That Section VII of said Ordinance No. 1065-06 as amended be amended appropriating $66,830 out of the 2005 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. IV. That Section VIII of said Ordinance No. 1065-06 as amended be amended appropriating $79,288 out of the 2006 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. V. That Section XII of said Ordinance No. 1065-06 as amended be amended appropriating $148,000 out of the Road and Street Improvement Fund for capital outlays in conjunction with street improvements. VI. That Section XIV of said Ordinance No. 1065-06 as amended be amended appropriating $27,000 out of the Municipal Court Technology Fund for the purchase of equipment and assets. VII. That Section XVI of said Ordinance No. 1065-06 as amended be amended appropriating $159,765 out of the Equipment Replacement Fund for the purchase of capital assets. VIII. That Section XX of said Ordinance 1065-06 as amended be amended appropriating $25,752 out of the Special Program COPS Grant to fund a school resource officer for the Police Department. IX. That Section XXVI-A be created in said Ordinance No. 1065-06 as amended be amended appropriating $3,050 out of the Law Enforcement Acquisition Fund to purchase police department equipment. X. That Section XXVI-B be created in said Ordinance No. 1065-06 as amended be amended appropriating $9,350 out of the 2002 Certificate of Obligations Expense Fund for capital improvements to the water works. Xl. That Section XXVI-C be created in said Ordinance No. 1065-06 as amended be amended appropriating $2,908 out of the Library Grants TIFB Expense Fund for the purchase of capital equipment and assets. XII. That Section XXVI-D be created in said Ordinance No. 1065-06 as amended be amended appropriating $581,802 out of the Electronic Meter Reading System Acquisition Fund for capital improvements to the water works. XIII. That Section XXVI-E be created in said Ordinance No. 1065-06 as amended be amended appropriating $58,265 out of the Electronic Meter Reading System Lease Purchase Expense Fund for the for the repayment of general long-term debt. XIV. That Section XXVI-F be created in said Ordinance No. 1065-06 as amended be amended appropriating $15,000 out of the Keep Richland Hills Beautiful Fund for waste reduction program activities. XV. That Section XXVI-G be created in said Ordinance No. 1065-06 as amended be amended appropriating $120,086 out of the 2006 Contractual Obligations Acquisition Fund for the purchase of capital equipment and assets. XVI. That Section XXVI-H be created in said Ordinance No. 1065-06 as amended be amended appropriating $13,000 out of the 2007 Contractual Obligations Acquisition Fund for the purchase of capital equipment and assets. XVII. That Section XXVI-I be created in said Ordinance No. 1065-06 as amended be amended appropriating $34,400 out of the 2007 Water Works Bond Issue Interest and Sinking Expense Fund for the general repayment of long term debt. XVIII. That Section XXVI-J be created in said Ordinance No. 1065-06 as amended be amended appropriating $2,086,523 out of the 2007 Water Works Bond Issue Interest and Sinking Revenue Fund for the construction of capital projects. XIX. That Section XXVI-K be created in said Ordinance No. 1065-06 as amended be amended appropriating $7,512 out of the NCTCOG LED Project Fund for the construction of capital improvements to the traffic system. XX. That Section XXVI-L be created in said Ordinance No. 1065-06 as amended be amended appropriating $53,621 out of the Traffic Enforcement Fund for the payment of fees regarding photo red light camera system. XXI. That Section XXVI-M be created in said Ordinance No. 1065-06 as amended be amended appropriating $34,162 out of the Police Department Homeland Security Fund to procure equipment and implement program to protect city facilities from terrorism. XXII. Severability Clause. That it is hereby declared to the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XXIII. Saving Clause. That said Ordinance No. 1065-06 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. XXIV. Effective Date. This ordinance shall be in full force and effect from and after its passage. XXV.
