BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized to enter into a compromise settlement of the claim of Larkin & Associates against the City of Jefferson for engineering costs in the design of the North Ten Mile Drive Project for the sum of $11, 222.41. Section 2. This Ordinance shall be in full force and effect from and after its passage and approval. The contract was for a base fee of $80 , 275. 00 with $8,000.00 for contingencies for , a total authorization of $88, 275 .00 . Ten Mile Drive - Jefferson City, Missouri FAU Project M-3112(501) L S A Job No. 79108 Dear Mike: Attached hereto is a current statement for services on the- N. Ten Mile Drive project in Jefferson City, Missouri . This statement brings the total amount billed to date to $97,414.07. As of the date of this billing we have submitted to you plans and specifications suitable for PS E E submittal to the State Highway Department. Based on our past experience, we expect a few rather minor comments on this submittal . After any changes are made to the plans or specifications, we would expect to assist you in advertising for bids, = attend a pre-construction conference, and assist you in any way you felt necessary in selecting a construction contractor for this project. We hope that this work can be accomplished for $2,000 to $4,000. You will recall that the contract for engineering services on this project was signed April 15, 1980. At that time we anticipated that all or at least nearly all of the work could be completed within one calendar year. For j various reasons this was not possible._ . I_.am sure that you are more aware than we are of the various property owner and governmental considerations that have combined to slow the progress of this project. However, because of the length of time involving completing this work, because of the many starts and stops that have been involved in this work, and because of some changes that have been made to the project, we have incurred greater costs than we originally anticipated. The following is an attempt on our part to list for you some of the additional costs and their reasons• in order to explain to you why the cost overrun occurred. Mr. Robert M. Bates, P.E. ® Page 2 December 29, 1983 ! 1. Because of the effect of inflation on labor costs we calculate that our costs as determined in accordance with the contract have been increased S7,352.77. These increased labor costs i by years breakdown as follows: 1981 $1 ,164.46 1982 $2,529. 19 1983 $3,659. 12 Total $7,352.77 2. Central Missouri Professional Services overran their subcontract with us by $1 ,926.95• As best we can determine this overrun was t caused by a decision to allow them to write the legal descriptions for the right-of-way and by some right-of-way staking that was requested by various property owners along the route. The decision to have them write the right-of-way descriptions was, I believe, ! the City's decision. I wrote to you in September of 1982 concerning this and asked at that time that should we overrun the original contract you consider an increase to cover the additional costs of writing the descriptions. - 3. Our original estimate did not allow for the preparation of a cultural resource survey,; however, such a survey was requested by the Federal Highway Administration. - Environmental Resource Center prepared this survey for the project at a cost of $385.00. This amount was paid by us and in turn charged to the project. 4. Although the court recorder for the public hearings was not the responsibility of the engineer in accordance with the contract, we paid the firm of J.D. Martin S Associates a total of $382.54 for preparing transcripts of the two public hearings. This was done at your request. 5. At the request of -property owners along the route, side streets were added to the project at Station 52+55 left and at Station 49+00 ' right. After the right-of-way plans and construction plans were essentially complete. These changes were made in approximately April of this year and included changes in storm sewers, grading limits and quantities. Also changed at this same time was a deceleration lane -added to the .intersection at Station 40+60 right. Although we do not have an exact accounting of the cost of these changes, we estimate the amount to be $3,000. , .• d Mr. Robert M. Bates, P.E. ® Page 3 December 29, 1983 + 6. During the early summer Miss Bonnie Hubert and 1 met with the water companies at Jefferson City to discuss relocation of some of their facilities. Following this meeting the profile grade of the project was changed between Station 88+00 and Station 94+00. This affected the storm sewers,. the permanent drainage easement, temporary construction easements, grading limits, cross sections, four drive profiles and project quantities. The cost of this change was $1 ,255.83.. . .. - 7. The entrances that were added to the project in item 5 above were moved to Station 50+20 left and right. This changed storm j sewers, grading limits, curb lines, temporary construction easement and side street profiles. The cost. of this change was $929.05. Also included in this change was the addition of fences at the right-of-way lines from Station 47+00 to 55+00 and the review of plans for a convenience store at Scott Station Road. 8. In October we met with Panhandle Eastern Pipeline Company in Jefferson City. Because we were able to share driving time with ® some other projects the cost of this meeting charged to this project was $151 .01 . 9. During November we again met with Panhandle Eastern Pipeline Company and revised storm sewers in the area of Scott Station Road and N. Ten Mile Drive in order to lessen the impact on their facilities. The cost of these storm sewer revisions was $515.75. 10. In December we again met with Panhandle Eastern and again revised the storm sewers in the area of Scott Station Road to further reduce the impact on their facilities. At this time we also added rock quantities both to the cross sections and to the proposal quantities. Another ma r cost that was alluded to early in this letter but can not be accurately pinned down, is the cost of the several start-ups in the design and plan preparation for this project. This is an intangible type cost in that it is hard to assign a specific number to things that have been forgotten, mislaid, or. things for which the reasoning can not be recalled immediately. However, all these things do take xime and therefore add to the cost of the design of the project. � w. i Mr. Robert M. Bates, P.E. I will be happy to furnish you whatever backup information we have in the way of bills, computer printouts of time, etc. We are not asking for any increase in the lump sum amount for profit, ibut we would like to be reimbursed for the additional costs that we have incurred on this project.
