SPONSORED BY COUNCILMAN ® ORDINANCE NO. �p AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH B. D. SIMON CONSTRUCTION COMPANY FOR THE TEMPORARY USE OF A PORTION OF CITY STREETS DURING A STATE CONSTRUCTION PROJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized and directed to execute a contract with B. D. Simon Construction Co. for the temporary use of a portion of city streets during a state construction project. Section 2. The contract shall be substantially the same in form and content as that contract attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Simon Construction Company ® Re: Construction Fence/Barricades Jefferson State Office Building State of Missouri Project No. 01-307-02-0006 HCC Project No. 20024 Gentlemen: This is to confirm our meeting of February 21 , 1984 at City Hall and of February 22, 1984, at the Jefferson Building, concerning the erection and location of the con- struction fence in conjunction with the above project. Per our conversations, we are agreed to the following: A. The Contractor is to provide - 1 . Jefferson Street Side - Starting at the alley and proceeding continuously north to Capitol Avenue, provide a four ft. high wire fence, four feet back of the curb (allowing parking and access to the parking meters) . A gated panel is to be provided opposite the front entrance for emergency access to the building entrance. 2. Capitol Avenue Side - Starting at Jefferson Street and proceeding approximately 58 ft. east, provide a four feet high fence, similar to and as a continuation of that along Jefferson Street. Then, for the next approximately 87 ft. east, provide a four feet wide covered walk- way, of 2x4 and 40 wood construction with a plywood floor, roof, and Sside adjacent to the construction site and a four feet high wire fence on the street side (requested by the Police Department for visibility) . The outside of this walkway will be provided approximately 20 feet out in the street, allowing for a 14 feet construction staging area at the Construction Fence/Barricades ® February 22, 1984 Page 2 curb. Then, for the remaining approximately 80 feet to the east corner of the building, provide a four feet high wire fence, similar to that along Jefferson Street. Note - the Contractor will keep clear a path to the Fire Department pumper connections on the north side of the building. 3. In Alley (South of Building) - For the limited period of time when the Contractor is removing and replacing the exterior skin, he will provide no more than a light duty chain or rope partition, so as not to limit through-traffic in the event of an emergency. 4. Also, B.D. Simon Construction is to name the City of Jefferson, Missouri as additional insured on the construction coverage. B. The City of Jefferson is to provide - l . Elimination of parking along both sides of Capitol Avenue in the vicinity of the Jefferson Building, and 2. Provide re-striping of Capitol Avenue for two, 15 feet lanes of traffic (one east bound and one west bound) . This work is to be done as ® soon as possible, so as to allow the contractor to construct his walkway. We have included sketches which we believe are in accordance with the above. Z � T This Agreement is made this day of by and between the City of Jefferson, Missouri (City) and B. 7D. •Simon Construction Company (Company) The Company is hereby authorized to use a portion of the streets and sidewalks - on Capitol Avenue and Jefferson Street in connection with its construction work on the state office building referred to as the Jefferson Building. The portion authorized to be used is specified in Exhibit 1 attached hereto. Company will comply with all of the requirements contained in Exhibit 1, including those shown on the map which is a part of Exhibit 1. Company will further comply with the following requirements : 1. Company will provide flagmen to control the movement of equipment and vehicles in and out of the protected area. 2 . Company will properly place and maintain the necessary signs and devices warning about the obstructions in the street and on the sidewalks . 3 . The portion of Capitol Avenue authorized for temporary use by Company shall be used solely for construction access , and shall not be used for the storage of equip- ment or materials . 4 . Damaged curbs, sidewalks and street pavement within the authorized area shall be repaired to City standards within 30 days of substantial completion of the project . Any damage to curbs , sidewalks and street pavement outside the authorized area shall be repaired to City standards within 30 days after the damage occurs . 5. Due to the large number of pedestrians in the area for 4th of July celebrations, Company will take extra precautions to assure that the obstructions are well- marked and that the construction site is secure during the period from midnight July 3d to midnight July 4th. * 6 . Company will pay to the City a $ SG& $ELdly removal cost for each parking meter required to be removed as a result of the construction project, and will pay $ * per week for each meter required to be removed and for each meter whose use is eliminated because of the rearrangement of the traffic lanes or any other cause connected with the project . 7. Contractor shall clear all obstructions and defects from the streets and sidewalks within 30 days of substantial completion of the project . Contractor shall notify City * Per conversation with Mike Bates April 14, 1984 cost to be : I. Remove and reinstall meter heads $1.00 each. a 2. Charge to be $. 50 per day per meter with Saturday, Sunday and holidays excluded. at least 7 days prior to removal of street obstructions in order to allow the City to arrange the restriping of the streets . 8. Contractor will not dispose of waste materials , ® including but not limited to, plaster, cement, hardware, and paint into the City's Sanitary or Surface Water Sewer Systems. City shall comply with the applicable provisions of Exhibit 1. Upon Company's failure to comply with the requirements of this agreement, City may terminate this agreement, remove any obstructions from the streets and sidewalks , and if necessary, make such repairs as are needed at Company's cost.
