AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERIC TO EXECUTE A CONTRACT WITH TOWNER COMMUNICATIONS SYSTEMS FOR THE EXTENSION OF A WARRANTY AGREEMENT ON A TELEPHONE SYSTEM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized and directed to execute a contract with Towner Communications Systems for the extension of a warranty agreement on a telephone system in. the John G. Christy Municipal Building for the Burn of $3, 297.25. Section. 2 . The contract shall be substantially the same in form and content as that contract attached hereto as Exhibit A. Section 3.. This Ordinance shall be in full force and effect from and after the date of its passage and approval. City, Missouri 65101 Dear Mr. Ilamburg Attached is a proposal for extending the warranty agreement on the ITT TD-250 telephone system we installed in the City Hall. Under this service agreement, we will make any necessary service and repairs to the system, including any parts as well as labor required. We will also perform any changes, moves or additions at our special lower rates. Details can be found in the attached "Extended Warranty - Terms and Conditions'. ?r The statement enclosed is in the amount of $3,297.25, which ' will extend the warranty on your entire telephone system from May 16, 1984 (the date the original warranty expired) through May 16, 1985. All systems sold by Towner Communications Systems are fully warranted for one year from date of installation, including all parts and labor. This warranty can be continued under our EXTENDED WARRANTY agreement, with the following terms: I. Fixed monthly rate, or single annual payment (in advance) . Annual payment is equal to eleven( 11) monthly payments. II. Warranty includes all parts and labor required for normal system maintenance. III. Service is provided during normal working hours (8:00 to 5:00) on business days. Overtime work will be charged at an hourly rate which is the difference between our normal rate and overtime rate (see below) . IV. Response time is: Major outage - 2 hours Minor outage - 24 hours (one working day) V. Warranty does not cover the cost of any additions, moves or changes requested by customer. It does not cover damages caused by negligence of customer, work done by unauthorized personnel, power line voltage surges, acts of God, fire or theft. VI. The following rates apply to customers with a. warranty agreement, for moves, changes, additions, or repairs not covered under warranty: First Hour (minimum) $35.00/hour Additional Hour ( 15 minute increments) 30.00/hour Overtime is 1508 of above rates. Charged for on--site time only (not for any travel time) . B. Customers who are not covered under a warranty agreement are subject to the following terms: I. Service provided on a time and materials basis. II. Service provided during normal working hours at the following rates: First Hour (minimum) $45.00,/hour Additional Hour ( 15 minute increments) 36.00/hour Overtime charged at 150% of above rates. Parts needing replacement will be charged at the standard list price. IV. Any customer owned equipment that cannot be repaired by Towner Communications will be returned to the manufacturor or a suitable repair facility. Charges for such repairs will be at our cost plus 25% handling fee. V. If a replacement part is provided by Towner Communications during the repair interval, a charge of 20% of the sale price of the part per 30 day period will be made. The minimum charge will be 20% of sale price. C. Rates quoted will be effective for one year. Rates do not include applicable sales tax.
