ORDINANCE NO.
AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1097-07
AND THE FISCAL YEAR 2007-08 BUDGET FOR THE CITY OF RICHLAND HILLS,
TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AND EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, adopted
Ordinance No. 1097-07 on September 11, 2007, approving and adopting a municipal
budget for the City of Richland Hills, Texas, for fiscal year 2007-08; and
I
WHEREAS, changed conditions and circumstances which could not have been
foreseen through the use of reasonable diligent thought and attention necessitated the
adoption of Ordinance No. 1105-08 on January 22, 2008 and Ordinance No. 1108-08
on February 26, 2008 amending the budget adopted by Ordinance No. 1097-07; and
WHEREAS, a public hearing on the following amendment to the fiscal year
2007-08 budget contemplated has been held as required by law.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That Section III of said Ordinance No. 1097-07, be amended to increase the
Drainage Utility Fund appropriation from $273,742 to $400,367 with such increase
allocated and appropriated as follows:
$126,625 such sum for the funding of an engineering analysis of the drainage I~'~,
comprehensive plan and drainage utility fee structure.
II.
Severability Clause. That it is hereby declared to the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, paragraphs and sections
of this ordinance, since the same would have been enacted by the City Council without
the incorporation in this ordinance of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
III.
Saving Clause. That said Ordinance No. 1097-07 of the City of Richland Hills,
Texas, shall remain in full force and effect, save and except as amended by this
ordinance.
IV.
Effective Date. This ordinance shall be in full force and effect from and after its
passage.
V.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the 11th day of March 2008 by a vote of rJ
ayes, and nays, and abstentions.
