AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO ENTER INTO A COMPROMISE SETTLEMENT OF THE
CLAIM OF BOOKER ASSOCIATES, INC. AGAINST THE CITY OF JEFFERSON,
PERTAINING TO THE DESIGN OF THE TRANSIT/CENTRAL MAINTENANCE
FACILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized
to enter into a compromise settlement of the claim of Booker
Associates, Inc. against the City of Jefferson for extra work
performed in the design of the Transit/Central Maintenance
Facility, for the sum of Six Hundred Fifty Seven and 58/100
Dollars ($657.58) .
Section 2. This ordinance shall be in full force and effect
from and after passage and approval.

We have reviewed the request for additional design fee. There
is no doubt that the extra design work was performed. Booker
redesigned the bus wash .door heaters after the contractor noted
problems with the roof mounted unit and the alternate standing
seam roof. The redesigned system is not working properly. Booker
has agreed to pay the cost of extending the duct work and revising
the control system at their cost, but feel that they should be
allowed to recover their design cost ($657. 78) .
We recommend paying Booker the additional design ' £ee requested.
We have retained $7, 685.81. We recommend payment of one-half of,
the retainage plus the extra be paid as soon as:
1) The bus wash duct work 'is extended and the revised control {
system is functional.
2) The lubrication system pumps are replaced and the system
is functional.
Final payment should be made after a 30 day trial period to make
sure the systems are working properly.

Dear Mr. Brose:
Per our conversation on October 3, 1984, Booker is making every effort, in
concert with Tom Hood, to close this project by the end of this month.
The two remaining issues which we discussed and having monetary impact
the Bus Wash Building and the lubrication system -- will now be resolved
without cost to the City. Booker agreed to participate financially in the
solution. A local subcontractor will be hired to extend the ducts and
revise the control system in the Bus Wash Building. J. C. Industries has
the lubrication system pumps on order, with delivery and installation
scheduled prior to the end of October.
Based on the above, we believe that Booker has been responsive to the City's
concerns and needs. We, in turn, ask the City's prompt action on two un-
resolved issues relating to our contract with you.
The first unresolved design contract issue deals with an additional design
fee of $657.58 which we believe is owed us as a result of the redesign
effort associated with the movement of the Bus Wash door heater units off
the roof into the building. This was an "owner's choice" design decision,
requested by the City, which modified our original design. Our recommenda-
tions on this- move were neither sought nor given. The attached itemized
listing delineates the extra design effort applied to executing this
decision. To date we have not requested nor received payment for this
additional design. We determined that we had failed to bring it to your
attention only during our recent close review of the project's history.
The second issue is the matter of our invoiced payments retained to date
by the City as a result of the Bush Wash Building and lubrication system
problems. With our present actions, we request that these retained funds
-- certainly the majority of them -- be released at this time.

If additional information is desired, please do not hesitate to call
Rich Walkenhorst, Buzz Vogt, or me. Booker wishes to see this project
completed to the City's full satisfaction as soon as possible. In spite
of these few lingering issues, the project has been very successful and
one for which we are proud to have been• the designers.
