AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING AND MODIFYING THE ZONING MAP OF THE CITY OF JEFFERSON,
BY AMENDING ORDINANCE 9598 BY ZONING PROPERTY LOCATED IN RECENTLY
ANNEXED TERRITORY, SITUATED IN PART OF SECTIONS 8, 9, 16, 17 AND
18, TOWNSHIP 44 NORTH, RANGE 12 WEST IN THE CITY OF JEFFERSON,
COUNTY OF COLE.
WHEREAS, the City Council of the City of Jefferson did on
August 2, 1982 duly enact Ordinance No. 9817, which: described
the area to be annexed, declared the annexation to be reasonable
and necessary to the proper development of the City, declared.
that the City had developed a plan of intent to provide services
to the area proposed for annexation, stated that a public hearing
had been held prior to the adoption of the ordinance, declared
the Ordinance to be effective on December 31, 1982 or when
approved by the voters as provided by law, whichever is .later,
and authorized annexation of the area; and
WHEREAS, the described area to be annexed is as follows :
Part of Sections 8, 9, 16, 17 and 18, Township 44 North,
Range 12 West in Cole County, Missouri, and more
particularly defined as being bounded by the following
described line:
Beginning at the northeast corner of the southeast quarter
of the southeast quarter of Section 9 , Township 44 North,
Range 12 West; thence southerly along the east lines of
Sections 9 and 16 to the southeast corner of the northeast
quarter of the northeast quarter of Section 16; thence
westerly along the quarter quarter section lines of Section
16 and 17 to the northwest corner of the southeast quarter
of the northeast quarter of Section 17; thence southerly to
the southwest corner of the southeast quarter of the
northeast quarter of Section 17; thence westerly along the
quarter section line of Section 17 to the easterly right-of-
way line of Fairgrounds Road; thence southwesterly along
said right-of-way line to its intersection with the westerly
line of the northeast quarter of the southwest quarter of
Section 17; thence southerly along the quarter quarter
section line to the south line of Section 17 ; thence
westerly along the section line to the easterly right-of-way
line of South Country Club Drive; thence northerly along
said right-of-way line to its point of intersection with
the northerly right-of-way line of Scruggs Station Road;
thence westerly across South Country Club Drive to the point
of intersection of the westerly right-of-way, line of South
Country Club Drive and the northerly right-of-way line of
Scruggs Station Road; thence westerly along the northerly
right-of-way line of Scruggs Station Road to its point of
intersection with the east line of the northwest quarter of
the southeast quarter of Section 18; thence on a bearing of
N 40 37' W to the southerly property line of Modine
Manufacturing Company, Inc. , which is also the center line
of the abandoned railroad; thence on a bearing of N 88° 35 '
39" W for a distance of 695 .0 feet; thence on a bearing of N
40 34 ' 01" W, to the southerly right-of-way line of Old
Lohman Road; thence easterly along said right-of-way line to
the western line of Section 17; thence northerly along the
section line to the northwest corner of Section 17; thence
easterly along the section line to the westerly right-of-way
line of South Country Club Drive; thence northeasterly along
said right-of-way line to the east line of the southeast
quarter of the southwest quarter of Section 8; thence
northerly along the quarter section line to the northwest
corner of the southwest quarter of the southeast quarter of
Section 8; thence easterly along the quarter quarter section
lines of Sections 8 and 9, to the point of beginning.
WHEREAS, on April 21, 1982, notices of the annexation public
hearing were sent by certified mail to all fee owners of record
having property in the proposed annexation area; and
WHEREAS, a public notice of the annexation hearing was
published on May 7, 1982 in the Jefferson City Post Tribune; and
WHEREAS, the public hearing was held on May 24, 1982; and
AWL WHEREAS, the City duly filed a Declaratory Judgment Action
in the 19th Judicial Circuit of the State of Missouri which said
Court on June 11, 1984 rendered a judgment in favor of the City
in a cause entitled "City of Jefferson, Missouri v. Ronnie J.
Jones, et al. " , CV183-3CC-1 finding the annexation of the un-
incorporated area to be reasonable and necessary to the proper
development of the City of Jefferson, Missouri; and
WHEREAS, the registered .voters of the City and registered
voters of the area proposed to be annexed at an election held on
April 2, 1985 approved the proposition for annexation by more
than a two-thirds majority; and
WHEREAS, the City has complied in all respects with 70.015
RSMo as they pertain to annexation; and
WHEREAS, the Zoning Map, which showed how the City proposed
to zone the recently annexed area and which was contained in the
area's Plan of Intent, was presented at a public hearing held on
Monday, May 24, 1982 as required by law; and,
WHEREAS, said Plan of Intent was incorporated by reference
in City of Jefferson's Petition for Declaratory Judgment
authorizing annexation presented to the 19th Judicial Circuit
Court, and
WHEREAS, it appears that the procedures set forth in
Ordinance No. 9598, the zoning code, relating to zoning have in
all matters been complied with.
WHEREAS, said annexation is now complete and said land has
now become a part of the corporate City:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The above described real estate is zoned in
accordance with the attached zoning map which is hereby
incorporated by reference and made a part hereof as if more fully
set out herein.
Section 2. This Ordinance shall be in full force and effect
from and after its passage and approval.
