BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized and directed to execute a contract with SUTRAK Air Conditioning Sales Corporation for five ( 5) RTS II--03 Series Coach Air Conditioning Conversion Packages, Installed for the sum of $31,975.00. Section 2 . The contract shall be substantially the same in form and content as that contract attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. MO-03-0020 THIS AGREEMENT made this 31st day of N9ay , 1985, between the City of Jefferson, a municipal-corporation of the State of Missouri, hereinafter called the "City" and SUETRAK USA TRANSPORT REFRIGERATION & AIR CONDITIONING CO.p INC. called the "Contractor" . WHEREAS, the City has determined a need for five (5 ) RTS II-03 series ( 35 ' x 96" ) coach air conditioning conversion packages installed. WHEREAS, the Contractor has the capacity to manufacture and deliver five ( 5) RTS II-03 air conditioning conversion packages installed. NOW, THEREFORE, in consideration of the mutual promises and agreements hereinafter set forth, the parties agree as follows: a) Obligations. Contractor agrees to sell and deliver to the City in accordance with the agreed schedule of delivery, and City agrees to purchase five ( 5 ) RTS II-03 series air conditioning conversion packages installed pursuant to the complete contract documents as cited in the specifications which are attached hereto and made a part hereof. b) Purchase Price. The City agrees to pay to the Contractor, in accordance with the bid proposal, a price of THIRTY GrE THOUSAND NINE HUNDRED SEVENTY FIVE DOLLARS AND NO CENTS ($31.975.00) f or f ive ( 5 ) RTS II-03 series air conditioning conversion packages installed as detailed in Contractor's Bid Proposal Form. c) Ineligible Contractors.
