HomeMy Public PortalAboutOrdinance No. 1125-08 09-23-2008 ORDINANCE NO. 1125--os AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1097-07 AND THE FISCAL YEAR 2007-08 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 1097-07 on September 11, 2007, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2007-08; and WHEREAS, changed conditions and circumstances which could not have been foreseen through the use of reasonable diligent thought and attention necessitated the adoption of Ordinance No. 1105-08 on January 22, 2008; Ordinance No. 1108-08 on February 26, 2008; Ordinance No. 1111-08 on March 11, 2008; Ordinance No. 1114-08 on April 8, 2008 and Ordinance No. 1116-08 on May 27, 2008 amending the budget adopted by Ordinance No. 1097-07 and WHEREAS, a public hearing on the following amendment to the Fiscal Year 2007-08 budget contemplated has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I . That Section III of said Ordinance No. 1097-07 as amended be amended appropriating $3,409,373 from the Enterprise Fund for Operating Expenses and Capital Outlays for Water and Sewer Works as set forth in the budget. II. That Section VIII of said Ordinance No. 1097-07 as amended be amended appropriating $66,751 out of the 2005 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. III. That Section XIII of said Ordinance No. 1097-07 as amended be amended appropriating $229,600 out of the Road and Street Improvement Fund for capital outlays in conjunction with street improvements. Iv. That Section X of said Ordinance No. 1097-07 as amended be amended appropriating $51,196 out of the 2007 Contractual Obligation Interest and Sinking Fund for the repayment of general long term debt principal and interest. V. That Section XV of said Ordinance No. 1097-07 as amended be amended appropriating $10,485 out of the Municipal Court Technology Fund for the purchase of equipment and assets. VI. That Section XVI of said Ordinance No. 1097-07 as amended be amended appropriating $124,779 out of the 2001 Certificate Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. VII. That Section XX of said Ordinance No. 1097-07 as amended be amended appropriating $106,657 out of the COG Planning Grant Expense Fund to complete transportation mobility and development planning project. VIII. That Section XXV of said Ordinance No. 1097-07 as amended be amended appropriating $590,688 out of the 2007 Contractual Obligation Expense Fund for the purchase of capital equipment, particularly a Fire Department Quint. IX. That Section XXX of said Ordinance No. 1097-07 as amended be amended appropriating $58,265 out of the Electronic Meter Reading System Lease Purchase Expense Fund for the for the repayment of general long-term debt. X. That Section XXX-A be created in said Ordinance No. 1097-07 as amended be amended appropriating $200 out of the Law Enforcement Acquisition Fund to purchase police department equipment. XI. That Section XXX-B be created in said Ordinance No. 1097-07 as amended be amended appropriating $303,642 out of the Traffic Enforcement Fund for the payment of fees regarding photo red light camera system. XII. That Section XXX-C be created in said Ordinance No. 1097-07 as amended be amended appropriating $30,473 out of the School Resource Officer Program Fund to fund a school resource officer for the Police Department. XIII. That Section XXX-D be created in said Ordinance No. 1097-07 as amended be amended appropriating $26,000 out of the 2001 Certificate Obligation Expenditure Fund for improvements to Midway Road. XIV. Severability Clause. That it is hereby declared to the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XV. Saving Clause. That said Ordinance No. 1097-07 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. XVI . Effective Date. This ordinance shall be in full force and effect from and after its passage. XVII. PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of the Richland Hills City Council on the 23ed day of September 2008 by a vote of 5 ayes, and -o- nays, and -o- abstentions.
