ORDINANCE NO. 10t15-5-
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING
ORDINANCE NO. 9404, THE FLOOD HAZARD ORDINANCE, BY DELETING
SECTION 3.D. PERTAINING TO COMPLIANCE, ENACTING A NEW SECTION
RELATING TO THE SAME SUBJECT AND ADDING A NEW SECTION RELATING TO
ACCESSORY STRUCTURES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
SECTION 1. Ordinance No. 9404, the Flood Hazard Ordinance,
is hereby amended by deleting Section 3.D. and enacting in lieu
thereof one new section to read as follows:
D. Compliance.
No structure, fill, or land shall be located,
placed, extended, converted or structurally altered in
the areas of special flood hazard as defined in Section
5.A. except in full compliance with the terms of this
ordinance and all other applicable regulations and
until an approved Development Permit has been secured
from the Department of Planning and Code Enforcement .
SECTION 2. Ordinance No. 9404, the Flood Hazard Ordinance,
is hereby amended by adding one new section, Section 5.C. (4)
relating to accessory structures , which shall read as follows:
(4 ) Accessory Structure - A structure whose use is
incidental, customary and subordinate to the principal
building on a lot and whose size and cost is small when
compared to the principal building. Accessory
structures include, but are not necessarily limited to,
detached garages, sheds and aircraft storage hangars.
An approved Development Permit must be secured prior to
the construction of an accessory structure and the
application for a Development Permit must contain or be
accompanied by:
a) An application for a Building Permit showing
the location of the accessory structure on the lot, the .
proposed type of construction, and the location of
service facilities, such as electrical and heating
facilities.

b) A statement signed by the owner specifying
that :
( i) the accessory structure will not be used
for human occupancy.
( ii) all contents subject to flood damage
can be removed in a short time with minimum effort .
( iii) the owner is aware that the cost of
flood insurance for the structure and contents will be
significantly higher than the rates for a similar
structure which has been elevated to the base flood
elevation.
C) A certification signed by a registered
professional engineer or architect specifying that if
the structure is constructed as designed and placed on
the lot as planned:
( i) the structure will have low flood damage
potential.
( ii) the structure will be anchored in a
manner to prevent flotation.
( iii) the placement of the structure on the
lot will cause no more resistance to the flow of
floodwaters than would a similar accessory structure
elevated on fill and/or the building will be
constructed on the site so as to offer the minimum
resistance to the flow of floodwaters.
( iv) service facilites, such as electrical
and heating facilities, will be elevated above the base
flood elevation.
d) Accessory structures must be built in
accordance with the specifications contained in the
Development Permit.

SECTION 3. This ordinance shall be in full force and effect
from and after its passage and approval.

PROPOSED AMENDMENTS
TO THE
FLOOD HAZARD ORDINANCE
The present ordinance:
( 1) Is not clear as to whether or not a Flood Plain
Development Permit is needed for placing fill in the
100 year flood plain.
( 2) Does not contain specific provisions for accessory
structures .
Section 1 of the proposed amendment makes it clear that a
Development Permit is needed before fill is placed in the 100
year flood plain. This should help in preventing problems which
can occur when fill is placed next to stream banks. The weight
of the fill can, during heavy runoff, cause the banks to collapse
and block the flow of the stream.
Section 2 of the proposed amendment contains provisions
relating to accessory structures. An accessory structure is a
subordinate building to the principal building on a lot or tract.
Detached garages, sheds and aircraft storage hangars are examples
of accessory structures . Accessory structures cannot be used for
human occupancy and have a relatively low replacement cost.
The requirements for this section were taken from the
"National Flood Insurance Program Handbook for Missouri
Communities" . Enactment of the accessory structures provisions
will permit the construction of storage hangars at the municipal
airport without having to place the hangars on fill.
