AUTHORIZING PURCHASE OF FLOATING DOCKS
WHEREAS, the Borough of Carteret, pursuant to N.J.S.A. 40A:11 -12a and N.J.A.C.
5:34- 7.29(c), may by resolution and without advertising for bids, purchase any goods or
services under the State of New Jersey Cooperative Purchasing Program for any State
contracts entered into on behalf of the State by the Division of Purchase and Property in
the Department of the Treasury; and
WHEREAS. the Borough of Carteret has the need to purchase Floating Docks for the
Carteret Marina utilizing the Sourcewell (formerly known as NJPA) Cooperative
Purchasing Program, from EZ DOCK Using co -op # 030117 -LTS in the amount of
$39,424.45; and
NOW, THEREFORE, BE IT RESOLVED, that the Borough of Carteret authorizes the
purchase of Floating Docks for the Carteret Marina, from EZ DOCK, using contract#
030117 -LTS 1300 Stagecoach Rd. Ocean View, NJ 08230 in the amount of $39,424.45.

A SO% deposit is required for all orders, with a maximum of $5,000.00 limit for all credit card transactions. Any remaining balance must
be paid by cash, check or wire transfer. Any past due invoices will Incur a monthly finance charge of 1.5 01o, with a minimum finance
charge of $1.00. Any cancellation on specialty orders will result in a loss of deposit. All final payments are required at the time of pickup
and /or delivery. Notwithstanding that delivery and Installation of any product may have been made, the customer acknowledges that
EZ Docks Florida ('EZ Dock') retains full legal title and ownership of delivered and /or Installed products relating to the quote until full
and final payment have been received by EZ Dock. Customer acknowledges that in the event the customer is unable or unwilling to
fulfill the contracted financial obligations, EZ Dock and its agents and employees shall be entitled at any time and without the need to
give notice enter upon any property upon which any products have been delivered or any part are stored, and shall be permitted to
remove such delivered and /or installed products from the site. Customer specifically grants EZ Dock and its agents and employees full
permission to enter customer's property for this purpose and acknowledges such entry by EZ Dock and Its agents and employees will
not be considered trespass. EZ Dock shall not held responsible for any resulting damages and /or losses from forces of nature including,
but not limited to tropical storms, hurricanes, floods, earthquakes, tornados, and fires. Please note, CUSTOMER IS RESPONSIBLE FOR
ALL FEDERAL, STATE AND LOCAL PERMITS.
