ORDINANCE NO. f 9817
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE CONTRACT WITH
BOYD, BROWN, STUDE & CAMBERN FOR ENGINEERING SERVICES FOR
THE REHABILITATION OF THE HIGH STREET VIADUCT.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI ,
AS FOLLOWS:
Section 1. The Mayor and City Clerk of the City of Jefferson
are hereby authorized to execute an amendment to the contract
with Boyd, Brown, Stude & Cambern for engineering services for
the rehabilitation of the High Street viaduct.
Section 2. The amendment shall be substantially the same in
form and content as Exhibit A attached hereto.
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

AMENDMENT
AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
Bridge and Bridge Deck Rehabilitation
Nigh Street Viaduct
This Agreement made this _ day of ;I � 985 amends the
Agreement dated the 7th day of May, 1984 by and between the City of Jefferson City,
Missouri (hereinafter called the "City"), and Boyd, Brown, Stude & Cambern,
Chartered (hereinafter called the "Consultant").
Whereas, the City desires to perform the construction inspection for the project
with City forces, and
Whereas, the Consultant is desirous of providing engineering assistance as
hereinafter described,
Now Therefore, in consideration of the mutual undertakings herein contained,
the parties agree to amend the aforementioned agreement as follows:
ARTICLE 11. SCOPE OF SERVICES:
Phase III: Construction Assistance.
A. Field Inspection - is deleted in its entirety and is replaced by:
A. Construction Inspection Assistance:
The Consultant will provide assistance to the City during the construction
of the project to include:
1. Review the Contractor's schedule of work.
2. Review and approve shop drawings and material certifications.
3. Conduct and attend preconstruction conference as well as any other
meetings necessary to complete the project.
4. Review work as requested by the City and provide the City a
recommendation to approve or reject the Contractor's efforts.
5. Assist the City's forces in the interpretation of contract documents.
6. Arrange for laboratory testing of materials as required for the
project (to be provided by Engineering Surveys and Services).

ARTICLE VI. COMPENSATION
Section 1 Is emended to read:
Section 1. Compensation for the services specified in Phase I and Phase II of the
SCOPE OF SERVICES, shall be paid on the lump sum basis specified below which
shall constitute full and complete compensation for the Consultant's services
including labor, overhead, travel, administrative and other indirect expense.
Phase I: Preliminary Design $ 5,240
Phase II: Final Design $ 5,160
Phase III: Construction Assistance services shall be paid at the standard
hourly rates specif led below plus reimbursement of out-of-pocket project expenses
which will include the testing services of Engineering Surveys and Services.
Standard Rates:
Principal $70/Fir
Sr. Engineer $50/hr
Engineer $48/hr
Technician $35/hr�f
A maximum fee of six thousand dollars ($6,040) will not be exceeded without
written authorization from the City. Compensation for Phase III services under this
Amendment to the Agreement will apply to all services provided after May 31, 1985.
ARTICLE IX. INDEMNIFICATION
Article IX is amended to read:
The Consultant hereby agrees and covenants that they will hold and save
harmless and indemnify the City, their officers, agents, servants, and employees from
liability of any nature or kind, in connection with the work to be performed hereunder,
arising out of any act or omission of the Consultant or of any employees or agent of
the Consultant or any of them, or associated with them including any persons, firm or
corporation engaged by the Consultant to perform any work required by or in
connection with the work required by this Agreement.
The City hereby agrees and covenants that they will hold and save harmless and
indemnify the Consultant, their officers, agents, servants, and employees from
liability of any nature or kind, in connection with the work to be performed hereunder,
arising out of any act or omission of the City or of any employees or agent of the City
or any of them, or associated with them including any persons, firm or corporation
engaged by the City to perform any work required by or in connection with the work
required by the amended Agreement.
