HomeMy Public PortalAboutORD10535 BILL NO. r SPONSORED BY COUNCILMAN ORDINANCE NO. AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH J. FAHRIdI, d/b/a J. FAHRNI MANAGEMENT FOR THE MAINTENANCE AND CARE OF LONGVIEW CEMETERY. BE IT 6RDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk of the City of Jefferson are hereby authorized to execute a contract with J. Fahrni, d/b/a J. Fahrni Management for the maintenance and care of Longview Cemetery for the sum of $5,220.00. Section 2. The agreement shall be substantially the same in form and content as Exhibit A attached hereto. Section S. This Ordinance shall be in full force and effect from- and after the date of its passage and approval. Passed 1/ t 5 - Approved - Pr si ing Of ices # Mayor ATTEST: City Clerk CONTRACT FOR THE MAINTENANCE AND CARE OF LONGVIEW CEMETERY FOR THE CITY OF JEFFERSON, MISSOURI This contract is entered into this .1-9,z*­ of 19 ff , by and between the City of Jefferson, Missouri, herein- after called the "City, " and "f� i /y(, AIM EA( T .� EA ICES hereinafter called the "Contractor. " This contract will be in effect for one full year from _NDda�11 I 1135- , through 0CTP�� 31, 12f(o . With the mutual. consent of both parties , the contract may be extended on an annual basis for up to one ( 1 ) additional year. WHEREAS, the City Cemetery Board of the City of Jefferson, Missouri, did on the q14- _ day of ocroA _ —_, 19__ Z_, award to the Contractor the contract for the Maintenance and Care of Longview Cemetery. NOW, THEREFORE, for an in consideration of the awarding of this contract and the work thereunder by the City to the Contractor, the said Contractor does hereby contract: and agree to do and perform said work, above specified and referred to and to accept payment therefore in the following manner: In the sum of X$6,220.00 to be paid by monthly installments in the sum of $518 .26 for the first month, and 3518.34 __ each month thereafter. NOW, BY THESE PRESENTS, it is agreed and understood by the parties hereto that the work performed under this contract will be inspected by the City Cemetery Board or its appointed representative of the City's Department of Planning and Code Enforcement, and the City reserves the right at any time to suspend or order the correction of work performed and to declare the contract forfeited for reasons of non-compliance of this contract. For the Maintenance and Care of Longview Cemetery the Contractor agrees to: ( 1) Mow the grass and vegetation as often as needed to keep vegetation less than six inches ( 6" ) in height. (2) To trim grass and vegetation on both sides of the cemetery fence and maintain the fence free from the intanglement of vines and other vegetation. ( 3 ) Trim grass and vegetation around all grave markers , headstones, and other appurtenances of the cemetery. (4 ) Trim and care for shrubbery. ( 5 ) Maintain all areas free of litter and unsightly debris. Niq ( 6) Maintain the entrance road and the ,inner roadway free of mud and debris . ( 7) Maintain headstones and section markers in proper alignment and position. (8 ) Maintain fences, gates, and storage building in good condition with . materials provided by the City for repairs. (9 ) To remove and dispose of grave decorations as needed or requested, but not to exceed four (4 ) times per year. ( 10) To level and re-seed grass for new graves . ( 11) To level and re-seed sunken grass areas as needed or requested by the City. ( 12) To provide fertilizer, grass seed, and insecticide approved by the City to maintain growth and a healthy condition of vegetation. ( 13 ) To provide and file with the City a performance bond in the amount of the agreed sum of the contract. ( 14 ) To completely indemnify and hold harmless the City for any and all damages, injuries , actions, costs, ASk attorney's fees and other expenses whatsoever arising out of the performance of said work whether the property or persons damaged are the servants and employees of the Contractor or third parties in no manner connected with said work. ( 15) Obtain and maintain throughout the term of this contract, Contractor's Public Liability Insurance in an amount not less than Eight Hundred Thousand Dollars ($800,000) for ali claims arising out of a single occurrence and One Hundred Thousand Dollars ( $100,000 ) for any one person in a single accident or occurrence, except for those claims governed by the provisions of the Missouri Workman's Compensation Law, Chapter 287, RSMo, and Contractor's Property Damage Insurance in an amount not less than Eight Hundred Thousand Dollars ( $800,000) for all claims arising out of a single occurrence and One Hundred Thousand Dollars ($100,000) for any one person in a single accident or occurrence. Contractor will also have the City of Jefferson listed as an additional insured on these policies. All interl.ineations, corrections, deletions and changes herein have been made prior to the execution of this contract.
