HomeMy Public PortalAboutr 21-048�Rezolufion of the oroug4 of (fartexef, N 51 #21 -48 Date of Adoption March 4, 2021 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH MOTT MACDONALD — WOODBRIDGE TOWNSHIP SEWER INTERCEPTOR & GENERAL SEWER CONSULTING SERVICES WHEREAS, the Borough of Carteret is in need of specialized engineering services with regard to the Woodbridge Township Sewer Interceptor and general sewer consulting services; and WHEREAS, the Borough's Consulting Engineers, Mott MacDonald, possess the requisite skill and expertise to provide said services; and WHEREAS, Mott MacDonald has submitted a proposal to provide said engineering services at a total cost not to exceed $35,000.00; and WHEREAS, the Mayor and Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. Account # 1- 05 -55- 501 -201 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. That the proposal from Mott MacDonald for engineering services related to the Woodbridge Township Sewer Interceptor and general sewer consulting services, in a total amount not to exceed $35,000.00 billable in accordance with Mott MacDonald's existing contract with the Borough is hereby approved. 2. That annexed hereto is a copy of said proposal 3. That this action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11- 5(l)(a) in accordance with the Borough's Pair and Open Process as authorized by law. The sharing formula which establishes the individual magnitude of contributor onsibility for the Rehabilitation Program is governed by the 1987 agreement Teen the Borough and the Township. Recently, Woodbridge developed an nate cost sharing formula using sulfide mass contribution to the interceptor h would have increased the Borough's cost share of the Rehabilitation. The )ugh rejected the sulfide mass contribution approach and fortunately, through a iation process, cost sharing will remain as outlined in the 1987 agreement. Separate from the ongoing cost sharing negotiations, Woodbridge Township has developed a staged approach to the study, design and construct improvements to rehabilitate various segments of its Woodbridge interceptor. The Township has broken the overall Woodbridge Interceptor into 6 different segments that will undergo rehabilitation design and construction. Note that not all of these 6 segments correspond to the segments identified in the 1987 Agreement. PROJECT UNDERSTANDING The Borough of Carteret discharges to the Port Reading Interceptor also named Segment 1 of the overall Woodbridge Interceptor. Plans and specifications for this segment have been revised and will soon be rebid. Per the 1987 agreement the Borough's share of the rehabilitation cost is 83.49 %. Woodbridge estimates the cost of rehabilitation for Segment 1 is approximately $14.4 million dollars. MMott MacDonald has reviewed the Segment 1 (Port Reading Interceptor) design M documents and identified areas where the design may not be adequately detailed. These areas could lead to cost extras and construction delays. There is also a large MATT MACDONALD allowance item in the contract documents with no clear description of how the allowance is to be used. As a major stake holder, the Borough of Carteret would like to participate in the construction phase of the Port Reading Interceptor segment of the Woodbridge Interceptor. PROJECT SCOPE February 19, 20211 Page 2 of 3 To protect the Borough's financial and,techhical interests, Mott MacDonald proposes the following engineering services scope,of work to assist with overseeing the Segment 1 construction phase of work. We will'perform the following tasks and provide monthly written updates to`the Borough during'tbe construction. Where needed we will notify the Borough of significant issues aithey arise. 1. Attend pre- bid„preconstruction'and progress meetings and obtain copies of meeting minutes., 2. Obtain and review copies;ofdraft addendum, prior to issue, during the bidding process and advise the Borough of construction cost or schedule 3. Obtain'and review copies of the bids received and bid evaluations prepared by Woodbridge Townships (WT) engineers. Mott MacDonald will advise the Borough regarding'seleetion'of the lowest acceptable bid. 4. , Obtain and review copies of the contractor's schedule and cost breakdown summaries and any updates submitted during construction. Mott MacDonald will use this information when reviewing progress payment applications and the construction schedule. 5, Mott MacDonald will visit the construction site at a minimum of once a week to observe'construction progress and compliance with contract documents. We would follow construction site safety procedures. Mott MacDonald will include site visit summaries in monthly reports to the Borough. 6.',-,Obtain and review copies of progress payment applications to review construction cost with overall progress. 7. Obtain and review contractor or WT change order requests and advise the Borough on cost and schedule impacts. 8. Obtain and review contractor requests for payment under any allowance item in the contract. 9. Obtain and review any contractor or WT request for substitute material changes. Mott MacDonald will evaluate if substitute materials provide the same or better function than the original contract documents. 10. Obtain and review copies of any contractor RFI and engineer's corresponding response. 11. Obtain and review copies of contractor required testing results that confirm the compliance of construction work. 12. Obtain and review copies of contractor bypass pumping plans and be provided adequate notice for the start of bypass pumping operations, major sewer tie ins, or other work that may impact sewage flow from Carteret. Mott MacDonald also assumes that Woodbridge or their consultants will provide the documents described above in a timely manner. Typically, the documents requested above are submitted electronically so including Carteret on the distribution should not be a burden to Woodbridge Township. M ENGINEERING FEE PROPOSAL MMott MacDonald is prepared to complete the above proposed scope of work upon the MOTT Borough's authorization. As the work effort for many of the tasks listed above will vary over the MACDONALD construction phase. Mott MacDonald estimates that from 20 to 36 hours per month over the life of the project may be required for the above described services during construction. We suggest the Borough authorize an initial budget of $35,000 to undertake this work on a reimbursable, "not -to- exceed" basis. Mott MacDonald would keep the Borough advised monthly of project status and costs.
