AN ORDINANCE RELINQUISHING CERTAIN EASEMENTS FOR UTILITY PURPOSES OVER
LAND LOCATED IN A PART OF OUTLOT NO. 75 IN JEFERSON CITY, MISSOURI.
WHEREAS, by an easement dated March 9, 1984, and Recorded in Book
279, Page 243, of the Records of Cole County, Missouri, a utility easement
was granted to the City of Jefferson, a municipal corporation, to
excavate within, install, construct, maintain and repair structures for
the routing and conveyance of utilities in, under and through the lots,
tracts or parcels of land described in Section 1;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easements
are surplus property of the City and are no longer needed for any public
purpose:
1) A strip of land ten (10) feet of even width across part of Outlot
No. 75 of the City of Jefferson, in Township 44 North, Range ll
West, in the City of Jefferson, County of Cole, Missouri; the
centerline of said ten (10) foot strip being more particularly
described as follows:
From the Southeast corner of said Outlot No. 75 of the City of
Jefferson; thence N 54° 02'05" W, along the South Line of said
Outlot No. 75, 1028.99 feet; thence N 21° 44149" E, 439.94 feet;
thence S 29° 50'01" E, 400.00 feet to the point of beginning for
this description; thence S 45° 09'59" W, 35.00 feet; thence S 41°
06115" E, 137.11 feet; thence N 60° 09'59" E, 195.00 feet; thence
N 860 20132" E, 111.82 feet to the point of termination.
Note: This description eliminates that portion of the easement
for Line "B" (Sta. 10+03.35 to Sta. 14482.28) described in Book
279, Page 243, Cole County Recorder's Office and has been revised
in the easement as recorded in Book 289, Page 459, Cole County
Recorder's Office as TRACT "l".
2) A strip of land ten (10) feet of even width across part of Outlot
No. 75 of the City of Jefferson, in Township 44 North, Range 11
West, in the City of Jefferson, County of Cole, Missouri; the
centerline of said ten (10) foot strip being more particularly
described as follows:
From the Southeast corner of said Outiot No. 75 of the City of
,Jefferson; thence N 540 02105" W, along the South Line of said
Outlot No. 75, 568.99 feet to the point of beginning for this
description; thence N 15° 06110" E, 211.10 feet to the point of
termination.
Note: This description eliminates that portion of the easement
for Line "D" (Sta. 0+00 to Sta. 2+11.1.0) described in Book 279,
Page 243, Cole County Recorder's Office and has been revised and
is replaced by the easement recorded in Book 259, Page 455, Cole
County Recorder's Office, and by the easement in Book 289, Page
459, Cole County Recorder's Office as TRACT "2".
Section 2. The easements described in Section 1, are hereby
relinquished, and the City does hereby release and abandon whatever
interest it has in the easements.
Section 3. The Mayor and City Clerk are hereby authorized to execute
any necessary legal document relinquishing all of the City's interest in
the tracts of ground described in Section 1.
Section 4. This Ordinance shall be in full force and effect from and
after passage and approval.

NOW WHEREAS, in consideration of the sum of One Dollar ($1.00), said
City of Jefferson, a Municipal Corporation, pursuant to an ordinance passed
by the City Council of the City of Jefferson, dated ,?- 3 -196 ,
does hereby release and abandon whatever interest it has in the said utility
easement and all other rights granted by the above-described instrument.
