SPONSORED BY COUNCILMAN ORDINANCE NO. 1/2 5✓ 3 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF A PUBLIC STREET KNOWN AS OLD NORTH TEN MILE DRIVE, LYING WESTERLY OF SCOTT STATION ROAD. WHEREAS, it has been shown to the City Council of the City of Jefferson, Missouri, that the owners of land adjacent to and abutting upon a part of old North Ten Mile Drive, lying northerly of Truman Blvd. and westerly of Scott Station Road, in the City of Jefferson, County of Cole, Missouri, has petitioned the City Council to vacate right-of-way as a public street; and, WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue as a right-of-way for a public street such street as described in Section 1 of this Ordinance, subject to a reservation in the City of an easement in that portion vacated for the maintenance, repair, location and relocation of all sanitary sewer, surface water sewer, or public utility facilities now existing or hereafter to be constructed within said right-of-way: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council of the City of Jefferson, hereby declares it necessary, reasonable and proper to discontinue as a right-of- way for a public street and forever vacate the following described street in said City, subject to the reservation in the City of the easement mentioned in Section 2 of this Ordinance: A part of the Northeast Quarter of the Southwest Quarter of Section 4, Township 44 North, Range 12 West, in the City of Jefferson, County of Cole, Missouri; being more paiticulary described as follows: From a stone at the Northwest corner of the Southwest Quarter of said Section 4; thence East along the Quarter Section Line, 2130.9 feet, more or less, to the West Line of Scott Station Road; thence S 36° 57'05" E along the said West Line of Scott Station Road, 810.42 feet to the Westerly Line of the "North Ten Mile Drive (now Truman Boulevard) - Scott Station Road Connection" built under Federal Aid Urban Project M-3112 (501); thence Southerly along the Westerly Line of said "Connection" the following courses: S 540 11159" W, 4.84 feet; on a curve to the right having a radius of 884.94 feet (Chord Bearing = S 29° 18150" E, Chord = 199.94 feet), a distance of 200.37 feet to a point on the South Line of the abandoned Old Bagnall Branch right-of-way, said South Line also being the North Line of now abandoned North Ten Mile Drive, and said point being the point of beginning for this description; thence continuing Southerly along the Westerly Line of the aforementioned "Connection" on a curve to the right having a radius of 884.94 feet (Chord Bearing = S 21° 28'02" E, Chord = 42.01 feet), a distance of 42.02 feet to a point on the Northerly Line of a tract described in Book 273, Page 565, Cole County Recorder's Office; thence leaving the said Westerly Line of the "Connection" and proceeding Southwesterly along the Northerly Line of the said tract described in Book 273, Page 565 the following courses: S 39 059103" W, 142.41 feet; S 33° 45'09" W, 205.79 feet to a point on the Northerly Line of Truman Boulevard; thence leaving the Northerly Line of the aforementioned tract described in Book 273, Page 565 on a bearing of S 56" 14'51" E and along the said Northerly Line of Truman Boulevard, a distance of 35.47 feet to a point 40.00 feet North of as measured radially to the plan centerline of the said Truman Boulevard as per Federal Aid Urban Project 1•1-•3112 (501); thence Southwesterly on a curve to the ]eft having a radius of 676.62 feet (Chord Bearing = S 55` 52117" W, Chord = 114.33 feet), a distance of 114.47 feet to a point on the Southeasterly Line of a tract as described in Book 228, Page 627, Cole County Recorder's Office; thence Northeasterly and West along the said Southeasterly and the Northerly Line of said tract the following courses: N 34° 24106" E, 257.67 feet; S 87° 01'47" W, 33.93 feet to a point on the aforementioned South Line of the abandoned Old Bagnall Branch right- of-way; thence leaving the North .Line of the tract described in Book 228, Page 627 and Northeasterly along the said South Line of the Old Bagnall Branch right-of-way on a curve to the right having a radius of 1776.37 feet (Chord Bearing = N 36° 48'36" L', Chord = 240.22 feet), a distance of 240.40 feet to the point of beginning. Containing in all, 0.237 acres, all in the City of Jefferson, County of Cole, Missouri. Section 2. All of that portion of the above vacated property is hereby retained as a perpetual easement or right-of-way for the construction, maintenance, repair, relocation and operation of sanitary sewers, surface water drainage, and all public utility facilities, and no permanent buildings or structures shall be located within or upon said easement without the prior written consent of the City. Section 3. The statutory right of reversion in the owners of the abutting property is hereby confirmed, subject to the easement expressly reserved in Section 2 of this Ordinance, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this Ordinance, in the right-of-way vacated. Section 4.
