ORDINANCE NO. �7 b
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , DECLARING REAL
PROPERTY TO BE SURPLUS, AUTHORIZING ITS SALE AND AUTHORIZING THE
MAYOR AND CLERK TO EXECUTE A DEED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The City Council finds the following real
property to be surplus property of the City, and as such
represents a burdensome cost, and the property is no longer
needed for any public purpose:
A part of Inlot No, 37 in the City of Jefferson, Missouri,
more particularly described as follows:
Beginning at the northeasterly corner of said inlot, thence
westerly along the northerly line 34 feet, thence southerly
parallel with the easterly line 198 feet 9 inches, to a
public alley, thence easterly along the southerly line of
said inlot 34 feet, thence northerly along the easterly line
198 feet 9 inches to the place of beginning.
Section 2. The Mayor and City Clerk are hereby authorized to
sell the property to the Housing Authority for the sum of One
Dollar ( $1. 00 ) and other valuable consideration.
Section 3. The Mayor and City Clerk are hereby authorized to
execute a warranty deed relinquishing all of the City's interest
in the tract of ground described in Section 1. Said deed shall be
substantially the same in form and content as the deed attached
hereto as Exhibit A.
Section 4. This ordinance shall be in full force and effect
from and after its passage and approval.

This indenture, Made on the �Flay of 7; y� A.D., Nineteen Hundred and
Eighty-Six by and between the City of Jefferson at trW county of Cole and State of
Missouri a municipal corporation organized and existing under the laws of the State of
Y. Missouri, Party of the First Part, and the Housing Authority of the City of Jefferson,
Missouri, State of Missouri, Party of the Second Part:
WITNF.SSETH, That the said Party of the First Part in consideration of the sum of
One Dollar to it paid by the said Party of the Second Part, the receipt of which is hereby
acknowledged, and by virtue and in pursuance of an ordinance of the City Council of said
Party of the First Part, does by these presents Remise, Release and forever Quit-Claim
unto the said Party of the Second Part, the following described Lots, Tracts or Parcels of
Land, lying, being and situate in the County of Cole and State of Missouri, to wits

TO HAVE AND TO HOLD the sane, with all the rights, immunities, privileges and
appurtenances thereto belonging unto the said Party of the Second Part, and their heirs
and assigns, FOREVER, so that neither the said Party of the First Part nor its
successors or assigns, nor any other person or persons for it or in its name or behalf
shall or will, hereafter claim or demand any right or title to the aforesaid premises or
any part thereof, but they and every one of them shall, by these presents, be excluded and
forever barred.
IN WITNESS WHEREOF, The said Party of the First Part has caused these presents to be

appeared George Hartsfield, to me rsonally k own, who, being by me duly sworn, did say
that he is Mayor of the City of Jefferson that the seal affixed to this instrawnt is
the corporate seal of said city, and that the said instrument was signed and sealed in
behalf of said city by authority of its City Council.
And the said George Hartsfield acknowledges said instrutent to be the
free%wtt and deed of said City.

Re: Request for Quit Claim Deed
Dear Allen,
As per our conversation, I am sending several attachments dealing with a tract of land
contained in a redevelopment block. This tract was obtained by the City in 1841 for
settlement of taxes due.
The Authority is currently negotiating with the State of Missouri for the sale of this
entire block for redevelopment. We are requesting a Quit Claim Deed for this property
so as to be able to present marketable title to the State.
I need to point out that this tract adjoins the alley, which we are requesting to be
vacated. If the alley is vacated prior to the Quit Claim, the description for the tract
would need to be revised to include that portion of the vacated alley that adjoins the
site.

This indenture rude and entered into this
23rd day of Pray, 1841, by and between Joseph 11. Gibson, City Collector
partyof the first part and the Corporation of the City of Jefferson
State of ILissouri party of the other parts
Witnesseth that Whereas I the, aforesaid Joseph Ii. Gibson
City Collector as aforesaid was duly appointed by the 2:ayor and con-
firmed by the board of .Alderman City Collector as of ore:aid for the
Year 1840 of the City of Jefferson to collect the City tai: of said
City according to an ordinance passed 'April 1, 1940, and whereas I
said City Collector did according to said Ordinance advertise for 30
dn,ys in the Jefferson Enquirer a paper printed in the aforesaid city
one lot piece or parcel of ground knovr� and described upon the plat
of said City now on file in the Secretary's Office of State as
Dot din. 37. '
And ;whereas I' dick accordin; to ordinance, on the 23d day of May, 1840,
offer according to ordinance as aforesaid said lot for sale for the city
tax due thereon in front .of the court house door of the county of Cole
In Jefferson City said lot for the said tax due thereon for the year
1839. And whereas the cor»oration of the City of Jefferson according
to said Ordinance passed April 1, 1840, became the purchaser thereof
said lot as aforesaid for the sum of 01.75 the amount 31' the city tax
dire thereon and whereas it was strip.ken of to and in the name of the
said iornorstion.

Reference: Opinion of parcel 6-6
Gentlemen:
t I have examined the abstract of title to the following
described property located in Jefferson City, Cole County,
`• Missouri, -to wit:
A part of Inlot No. 37 in the City of Jefferson,
Missouri, more particularly Described as follows:
Beginning at the northeasterly corner of said
inlot, thence westerly along 'the northerly line
34 feet, thence southerly parallel with the
easterly line 195 feet 9 inches , to a public
alley, thence easterly along the southerly line
of said inlot 34 feet, thence northerly along the
easterly line 198 feet 9 inches to the place of
beginning.
Said abstract bears a certificate of the Cole County
Abstract Company dated July 29 , 1968.
Basing my opinion on said abstract, I find title to be
duly vested in Vosholl Wilson, subject to the following
exceptions and objections:
In 1841 Joseph M. Gibson, City Collector of the
City of Jefferson, conveyed Inlot No. 37 to The
Corporation of the City of Jefferson; Book G,
pane 524 . This tax deed constitutes a break in
the chain of title which is fatal unless cured.
2. 1968 taxes are assessed and constitute a lien
against the property.
