ORDINANCE NO. 106,0
AN ORDINANCE. OF THE CITY OF JEFFERSON, MISSOURI, LEVYING AND ASSESSING A
SPECIAL TAX BILL AGAINST THE LOTS OR TRACTS OF LAND FRONTING AND ABUTTING
ON W. MAIN STREET IN THE CITY OF JEFFERSON, MISSOURI, FOR THE IMPROVEMENT
OF INSTALLING SIDEWALKS ON SAID ROADWAY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1.. There is hereby levied and assessed at the rate and cost
price per front foot as specified in Section 2 of this Ordinance, against
the aggregate cost or tracts of land fronting or abutting on W. Main
Street in the City of Jefferson, Missouri, for the improvement of
installing sidewalks on said roadway, the sum of $2,904.93 as total
costs of the improvement of said roadway, amount to 2,770.32 front feet;
the cost price per front foot is $1.03 per front foot on property which
had existing curb and gutters.
Section 2. For the purpose of paying said improvement of said road-
way, there is hereby levied and assessed the sum of $1.03 as a special tax
against each front foot of ground fronting or abutting said roadway, and
contained in such lot or piece of ground fronting or abutting said
improved roadway.
Section 3. The name of each property owner or owners and the
description of each lot or piece of ground fronting or abutting on each
side of said roadway and the number of front feet owned by each owner or
owners and contained in the lots or tracts of land so owned and abutting
said roadway and the cost price per front foot for said improvement and
the amount hereby levied and assessed as special tax for said improvement
against each lot or piece of ground fronting or abutting said roadway is
listed as follows:

Lot No. 51 of Westmoreland Heights Addition to the City of Jefferson,
Missouri, per plat of record in Plat Book 4, page 28, Cole County
Recorder's Office;
EXCEPT that part conveyed to the City of Jefferson for street purposes as
described in warranty deed of record in Book 123, page 223, Cole County
Recorder's Office.
Subject to easements of record to Missouri Power and Light Company of
record in Book 111, page 571, and to Capital City Telephone Company of

Beginning at a point that is 636.4 feet north 70 degrees west of the point
of intersection of the southerly line of the Jefferson City and California
public road (also known as North Ten Mile Drive Road) and the east line
of the west half of said Section 2; thence south 20 degrees west 266 feet,
more or less; thence west 90 degrees bearing north 70 degrees west 100
feet; thence north 20 degrees east 284 feet, more or less, to the
southerly line of aforesaid road; thence southeasterly along southerly

A tract of land lying in the southwest part of the east half of the
northwest fractional quarter and in the north part of the northeast
quarter of the southwest quarter in Section 2, Township 44 of Range 12
particularly described as follows:
Beginning on the southerly line of the Jefferson City and California
public road at a point that is 636.4 feet north 70 degrees west of the
point of intersection of the' southerly line of said public road and the
east line of the west half of said Section 2, which said point is also the
northwest corner of a tract of land deeded to James F. and Margaret W.
Harner of record in Book 62 at page 638, Recorder's Office, Cole County,
Missouri; thence from said beginning point south 21 degrees west along the
westerly line the Harner lot, 540 feet to the northerly line of the right-
of-way of the Bagnell Branch of the Missouri Pacific Railroad Company;
thence northwesterly along the northerly line of said right-of-way to a
point 20 feet east of the west line of the east half of said northwest
fractional quarter; thence north 20 foot distance and parallel with said
line, to the southerly line of said public road; thence southeasterly with
the southerly line of said road to the point of beginning.
Reserving a right--of--way twelve feet wide along the west side of above-
described property, running from the public road on the north to the
railroad right-of-way on the south to be used by the grantors herein,
their heirs or assigns, as a roadway from the public road to the land of
grantors lying south of said railroad with the provision that should said
grantors convey said land south of railroad to the owner or owners of any
adjoining land to said land, there the twelve foot right-of-way herein
reserved shall be vacated and the fee simple title thereof vested without
restrictions in said second parties, their heirs, or assigns.

The parties of the second part are to pay all taxes due and payable in
December 1935 and thereafter.

tract conveyed to Sylvester Dulle and wife, by deed of record in Book 136,

line of said public road; thence south 58 degrees 40 minutes east, along
the southerly line of the public road, 123 feet, to the beginning point of
this description.

Section 4. That the City Clerk is hereby instructed to make out
special tax bills in favor of the Contractor, Twehous Excavating Co. , Inc„
Jefferson City, Missouri, for the within-mentioned work in accordance with
the ordinances of the City of Jefferson, Missouri, relative to said kind
of work in accordance with the Ordinance of said City in regard to said
work.
Section 5. This Ordinance shall take effect and be in full force
from and after its passage and approval.
