ORDINANCE NO. to
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH LINCOLN
UNIVERSITY FOR THE TEMPORARY STORAGE OF A PASSENGER BUS.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and Clerk are hereby authorized and
directed to execute a contract with Lincoln University for the
temporary storage of a passenger bus .
Section 2. The contract shall be substantially the same in
form and content as that contract attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

CONTRACT
This Contract made and entered into this day of
19 ,6, by Lincoln University and the City of
Jefferson, Missouri, a municipal corporation, hereinafter called
the "City. "
WITNESSETH:
WHEREAS, The University has requested the City provide a
temporary storage area for a 47 passenger bus , and
NOW THEREFORE, the parties to this contract agree to the
following:
1. Storage: The City will provide outside storage for the
University's bus at the City' s old maintenance facility yard. An
electrical outlet will be provided for a block heater. A Ten
Dollar ( $10.00 ) per month charge to the University for storage
and electric usage will also be made by the City. The University
will be responsible for the maintenance of the block heater and
seeing that the electrical outlet hookup is made.
2 . Access : The City will provide the University a gate key
for after hours and weekend access to the City's storage lot,
solely for the purpose of parking and removal of the University's
bus .
3 . Payments : The University agrees to pay the cost -as
outlined in Paragraph 1. The City will bill the University on a
monthly basis . The amount. of the bill shall be paid within
thirty ( 30 ) days after the billing date.
4 . Term: The term of this contract will be one year
® beginning January 1, 1986 , through December 31, 1986 .
® 5. Insurance: The University will provide the City proof
of automotive liability and physical damage insurance on the bus .
6. Indemnity: The University will hold the City harmless
from any darnage to the University's bus resulting from any cause
except the negligence of the City, its officers, employees and
agents while on City property. This indemnity includes , but is
not limited to, damage stemming from vandalism and accident. The
University will also hold the City harmless from any or all
damage or injuries caused to any person by the action(s ) of
University employees or agents present_ on City property pursuant
to this contract.
7 . Termination: This Contract may be tprminatPd by either
party by giving thirty days ( 30 ) written notice.
