AN ORDINANCE RELINQUISHING A CERTAIN EASEMENT FOR UTILITY
PURPOSES OVER LAND LOCATED IN SCHOTTHILL WOODS SUBDIVISION
SECTION ONE IN JEFFERSON CITY, MISSOURI.
WHEREAS, per plat of record as recorded in Plat Book 11,
Page 145, of the Records of Cole County, Missouri, a utility
easement was granted to the City of Jefferson, a municipal
corporation, to excavate within, install, construct, maintain and
repair structures for the routing and conveyance of utilities in,
under and through the lots, tracts or parcels of land described
in Section 1;
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described
easement is surplus property of the City and is no longer needed
for any public purpose:
Part of Lot 43 in Schotthill Woods Subdivision, Section One,
per plat of record as recorded in Plat Book 11, Page 145,
Cole County Recorder's Office, being more particularly des-
cribed as follows:
Beginning at the southwest corner of said Lot 43; thence N
qr 040 07' 28" W. along the Westerly Line thereof, 19.88 feet;
thence N 86° 46' 21" E, 617.62 feet to a point on the
Easterly Line of said Lot 43; thence S 25° 51' 17" W, along
said Easterly Line 22.74 feet to the southeast corner
thereof; thence S 86° 46' 21" W, along the Southerly Line of
said Lot 43, 606.26 feet to the Point of Beginning.
Containing in all, 0.28 acres.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon
whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to
execute any necessary legal document relinquishing all of the
City's interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect
from and after passage and approval.
