AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING ORDINANCE
NUMBER 98760 RELINQUISHING UTILITY RIGHTS IN THE EAST-WEST ALLEY
BETWEEN WEST MCCARTY STREET AND US HIGHWAY 50/63 FROM WALNUT STREET TO
MULBERRY STREET.
WHEREAS, it has been shown to the City Council of the City of
Jefferson, Missouri, that all public utilities have been re-located
out of the east-west alley between West McCarty Street and US Highway
50/63 from Walnut Street to Mulberry Street; and,
WHEREAS, it has been further shown there will be no further need
for the perpetual easement or right-of-way for public utility
facilities:
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
_Section 1. The City Council of the City of Jefferson,
hereby declares it necessary, reasonable, and proper to
relinquish the perpetual utility easement reserved in the
vacation of the east-west alley between West McCarty Street and
U: Highway 50/63 from Walnut Street to Mulberry Street as
stipulated in Section of Ordinance Number 9876.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon
whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized
to execute any necessary legal document relinquishing all of the
City's interest in the tract of ground described in Section 1.
Section 4. This Ordinance shall be in full force and effect
from and after its passage and approval.
