ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AMENDING THE CITY
CODE TO ALLOW CERTAIN CITY POLICE OFFICERS TO RESPOND TO
EMERGENCY SITUATIONS OUTSIDE THE CITY.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. Section 24-23 of the City Code is hereby amended
to add one new subsection, to read as follows :
( c) Every member of the police department who has completed
the police training program as established by chapter 590, RSMo,
shall have the authority to respond to emergency situations
outside the City limits .
( 1 ) For the purposes of this section, "emergency situation"
shall mean any unforeseen combination of circumstances or events
involving danger or imminent danger to human life or property
which requires immediate action.
(2 ) This section shall not be construed to authorize any
member of the City police department to continue pursuit, by
motor vehicle or otherwise, where members of a police department
of another jurisdiction or the Missouri Highway Patrol have
joined the pursuit and the member of the City Police department
is not in a position to immediately apprehend the person being
pursued.
( 3 ) This section shall not be construed to authorize any
member' of the City Police department to make an arrest outside
the City ]limits or use his weapon except to protect himself or to
effectuate an arrest for a serious felony endangering the lives
or threatening serious property damage to one or more persons in
the area.
(4 ) Any member of the City Police department who responds
to an emergency situation shall promptly inform the City police
department that he is leaving the City and for what reason,
unless to do so would jeopardize the life of the member or any
other person. The member shall return to the City upon being
ordered to do so. No member shall be required by reasons of this
ordinance to leave the City to respond to an emergency situation,
but said member shall use his discretion and judgment as to
leaving the City to respond to any emergency situation. It shall
be the policy of the City that said members shall not leave City
inhabitants with inadequate police protection or be absent for
extended periods of time, but that the response shall be in aid
of and to assist the authorities of the county or municipality in
which the emergency situation is located.
Section 2. This ordinance shall be in full force and effect
from and after its passage and approval.
