ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI AMENDING THE CITY
CODE TO PROVIDE FOR THE RELEASE OF CLAIMED PROPERTY IN THE
POSSESSION OF THE POLICE DEPARTMENT.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI:
Section 1. Section 24-3 of the City Code is hereby amended
to read as follows :
(a) The chief of police shall be authorized to sell. all
unclaimed personal property recovered by or turned into the
police department, except guns . Items shall be retained by the
police department for sixty ( 60 ) days from the date of
possession. If the property is not claimed by its owner within
sixty ( 60 ) days, the chief of police may sell the property at
public auction.
(b) The chief of police shall be authorized to release all
claimed personal property, except guns, recovered by or turned in
to the police department. Such release shall be made at any time
prior to the beginning of a sale conducted pursuant to this
section at which the property to be claimed is being sold. The
claimant shall produce proof sufficient to convince the chief of
police or his authorized deputy that it is more probable than not
that the claimant owns the property to be claimed. An officer
releasing any property pursuant to this subsection shall obtain a
receipt for the property, and make a written record of the proof
offered by the claimant. A person who -turns in personal property
to the police department may assert a claim pursuant to this
section.
(c) All sales of personal property shall be at public
auction. The City Clerk shall cause notice of such sale to be
published in a local newspaper and on local radio stations at
least seven (! ) days prior to the sale.
(d) The proceeds of such sale, after deducting the expenses
of the sale, shall be deposited in the general revenue fund of
the city, and shall be accompanied by an itemized list of
expenses of the sale and a verified list identifying the article
sold, the sale price and name of the purchaser.
