ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH CAPITAL CITY
WATER COMPANY FOR THE RELOCATION OF UTILITIES IN CONNECTION WITH
THE WEST MAIN STREET BRIDGE.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and Clerk are hereby authorized and
directed to execute a contract with Capital City Water Company
for the relocation of utilities in connection with the West Main
Street bridge for the sum of Eight Thousand Five Hundred Sixty-
three Dollars ( $8, 563 .00 ) .
Section 2 . The contract shall be substantially -the same in
form and content as that contract attached hereto as Exhibit A.
Section 3 . This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

UTILITY AGREEMENT
THIS AGREEMENT entered into by and between Capital City
Water Company, a corporation existing under the laws of the State
of Missouri, with its address of 906 West High ,Street, Jefferson
City, Missouri, (hereinafter called "Company" ) , and the City of
Jefferson, acting by and through the City of Jefferson
(hereinafter. called "City" ) , WITNESSETH, THAT:
WHEREAS, City proposes to construct a bridge and approach
roadway designated as BRO-026( 6 ) , Bridge No. 218RO2 .5, in
accordance with certain road plans on file in the office of the
Director of Public Works, Jefferson City, Missouri, and
WHEREAS, in order to improve said roadway in accordance with
said plans, it will be necessary to adjust certain facilities to
maintain the present services of said Company, such changes being
generally shown in legend on plan marked Exhibit "A" and estimate
of cost marked Exhibit "B" attached hereto and each made a part
hereof.
NOW, THEREFORE, in consideration of the mutual convenants
contained herein, IT IS AGREED AS FOLLOWS:
( 1) Company releases to City such right, title and interest
which Company may have in and to the right-of-way of said roadway
improvement.
(2 ) Company agrees that the detail plan and estimate of
cost for the required adjustment of Company's facilities have
been prepared in accordance with the provisions of the Federal
Aid Highway Program Manual, 6-6-3-1, dated September 6,
1985, and any amendments thereto which by reference are made a
part of this agreement . Company also agrees that the work will
be performed in accordance with said manual.
( 3 ) After approval of said detail plan and estimate of cost
by the City, Missouri Highway & Transporation Commission, and
Federal Highway Administration the Company will proceed, upon
notification by the City, without unnecessary delay to make the
changes in its facilities as shown by said plan and estimate.
Company further agrees to notify the City five ( 5 ) days prior to
beginning the work.
(4 ) City agrees to furnish Company with all necessary
information on the highway improvement in order to properly carry
out the utility relocation.
( 5 ) If substantial change is made in the original plan and
extent of the work, Company agrees that an adjustment of City' s
obligation as set out in Paragraph 8 will be made by supplemental
agreement or change order approved by City, Missouri Highway &
Transportation Commission and Federal Highway Administration,
PRIOR to the performance of the work.
( 6 ) Upon completion of the work provided herein, Company
shall remove all leftover materials and debris resulting from the
work and leave the right-of-way in a neat, workmanlike condition,
free of holes, mounds of dirt, or other objectionable material.
(7 ) At all times when work is being perfprmed by Company
under such conditions as will affect traffic on the public
highway, Company shall display warning signs, barricades, flags,
light and/or flares as circumstances may require and shall employ
and use a flagman when required for safety to the travelling
public.
(8) The total. cost of the work required for the highway
construction is $17 , 126. 00 . City' s obligation toward the total
cost of the work under this contract shall be 50 percent thereof.
Upon completion of the work in accordance with said plans and
estimate, Company shall submit six copies of a statement to the
City. It is agreed that when completion of the work in
accordance with the plan has been verified by City or their
authorized agent, City shall, within thirty ( 30) days, reimburse
Company $8,563 . 00, listed amount being City's total obligation
for this contract.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed by their duly authorized officials .
