MINUTES OF THE POND PROPERTY PLANNING COMMITTEE

Call to Order, Declaration of a Quorum, Meeting Participation Statement, and Recording Statement
Chair Wilcock called the meeting to order at 4:00pm and declared a quorum. Chair Wilcock read the meeting
and recording statements.

Review and Discuss Draft Presentation Materials and Planned Format for Second Community Forum
Elizabeth Randall noted that the key interests of the community were gathered and then translated into a set
of scenarios that they hope addresses and provokes the interests and questions that the community has
expressed. The five sceharios will be presented to the community and the forum will solicit feedback. The
scenarios include thingsc.that Reed Hilderbrand want to confirm are interests or not interests and provide a
range of options.
Members of the committee had the opportunity to provide feedback, which included:
• Happy to see consistent access to the beach/pond
• Glad to see rustic day camp/education/nature piece in all 5 scenarios
• Suggestion to change the language that says "limit new buildings" as it may be misleading
• "Housing Revenue" may be a misleading term, as it is not a revenue generating parcel
• Surprised only one scenario protects our open space and drinking water
Ms. Randall noted that they will be relying on methods from the last forum, providing stickers to residents to
provide input on the different scenarios and vote for options they prefer. Ms. Randall agrees that there may
be a lot of folks who gravitate to the option without housing, and this will be helpful to understand if there
were very clearly an overwhelming number of stickers that indicated a strong preference for one of the
options. Ms. Randall reminded the committee that there will be additional forums to continue to narrow
done options, for now vie are keeping everything on the table that the community has shown interest in.

As for the commented about revenue generation, the survey results noted a lot of feedback about managing
costs and considering revenue generation, so one proposal presents an option to see what it might look like
to have revenue generation potential. There was a lot of interest in science, education, and arts residency
options. 11
The committee continued their discussion and comments, it was noted that the committee needs to keep in
mind that in looking at the parcel, we need to keep it in context with other documents that guide Brewster,
including the Local Comprehensive Plan. There was discussion on parking options, ripting that there is no
new parking options within the wet land buffer zone. The proposed scenarios are intended to show both
ends of the spectrum.
Other comments made by committee members included: s
• Housing is incredibly important on the Cape, having some sort of plan makes sense.
• Doesn't seem like the mention of a wastewater treatment plant or cell towers belongs on the parcel.
• Keep in mind that few people have seen the property or know where it is. Thinks it would be helpful
to provide more information about property and the surrounding parcels.
Discussion continued regarding the forum process and the results of the survey. Ms. Kalinick announced that
the second community forum will be held on August 5, 2023. There will be three sessions and the Bay
Property will be open to the public from 12pm — 5pm. Regarding the revenue question, the Select Board has
received feedback related to their Strategic Plan related to taxes, money and fiscal responsibility in relation
to the Cape Cod Sea Camps properties. 1'
Discussion of Re ug latory.guidelines- Paul Anderson, Water Superintendent and Jon Idman, Town Planner
Paul Anderson clarified the concern for sewers on the property, noting that just beceuse a Zone II exists
doesn't necessarily mean that disposal of sewage within the Zone II is a terrible idea Stating that there are
plenty of septic systems within a Zone II. If there is the ability to capture some of the sewage in private
systems, relocate it further away, treat it in a more advance matter and reinject it irvto the soil there is more
of a benefit, but is not saying that it is a good idea on this property.
Mr. Anderson noted that Brewster currently has five operational wells, during the winter the Town can run
on one and during the summer months we need all five. There is one more approved source in the Punkhorn
area that could be developed in the future. The Town would need to look at least one more source, possibly
two for the build out of Brewster. Mr. Anderson noted that the Town could also look at the possibility of
water conservation instead of developing sources, as a significant amount of water is used. Overall, the
Town is in good shape currently in regards to the amount of water that is available. There are concerns with
emerging contaminants, which would likely be treated at the source if it became a problem. Mr. Anderson
shared that the Water Department is looking to develop a Master Plan next fiscal year that will look at the
current status and what Brewster will need in the future. Mr. Anderson reviewed the requirements for a
well, including establishing a protective radius under Massachusetts regulations.

There was a question regarding the adjacent Woodlands Property and the conservation restrict which states
no well development. Ms. Kalinick stated that it is unclear whether it would be allowed to have an access
road that would go through the protective radius of a well. Mr. Anderson provided some ideas about what
may be allowed on the protective radius, but all the plans would need to be approved by the State. The
Water Department must own, maintain, and control the protective radius.
Jon Idman reviewed the water protection overlay district, Article 11 of the Zoning bylaw. Sharing that the
last update was in 2008, pursuant to a process with the Cape Cod Commission called a District of Critical
Planning Concern (DCPC). These overly districts avoid the need to change the underlying zoning. Adding that
within the DCPC you have a small commercial district, an industrial district and mostly residential zoning.
With an overlay district you can add more liberal provisions if you want to allow more in the overlay district
or have more restrictive provisions. Mr. Idman noted that a special permit may be required for certain uses.
Mr. Idman explained Natural Resource Protection Design, NRPD, adding that it can only be done in the water
protection district of critical planning concern. He does not think the committee needs to concern
themselves unless there is an interest to subdivide the land. The NRPD is an alternate way to subdivide land
and allows a level flexibility to subdivision. Mr. Idman in response to a question about conflicting with
zoning bylaws noted tftat the Town intent at this point should be to articulate that there may be a carve out
for municipal infrastructure or public utility infrastructure. Adding that within the DCPC you can have a
wastewater plant/facility, there would be specific criteria that would have to be meet and there has to be an
identified water quality problem that needs to be solved.
Short Term Uses of Property
a. Conservation Dray follow up — July 8, 2023 Received great feedback, people liked the two-sided map
and showed interested in learning more about the Pond Property.
b. Guided walk report update- updated plans and revised the route, next one is on July 29, 2023
c. Discussion of rescheduling Kayak trips to September from a Harwich or other landin - There will not
be a trip in the fall, we will look to reschedule for the Spring.
Feedback Request for Select Board Annual Retreat on Former Sea Camps Building Block
Chair Wilcock shared that he would like to gain public access to the property relatively quickly, within 1-2
years at it would beneficial. He also suggested that the Parks and Recreation goal to have "boots on the
ground" would be best with a 2 -to -5 -year goal.
Elizabeth Taylor suggested that the Select Board consider the other building blocks, including climate
resilience as it relates to the Cape Cod Sea Camps Planning.
