AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH MILLER ASSOCIATES
ENGINEERS, PLANNERS AND SURVEYORS, INC. , FOR DRAFTING AND
REPROGRAPHIC SERVICES.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Mayor and Clerk are hereby authorized and
directed to execute a contract with Miller Associates Engineers,
Planners and Surveyors , Inc. , for drafting and reprographic
services for the sum of $2,992.00 .
SECTION 2. The contract shall be substantially the same in
form and content as that contract attached hereto as Exhibit A.
SECTION 3. This ordinance shall be in full force and effect
from and after the date of its passage and approval.

APPENDIX{ A
CONTRACT
for
DRAFTING AND REPROGRAPHIC SERVICES
JH' S�CONTRACT, made at Jefferson City, Missouri , this �4day
of (��; ,c=�, /'�G by and between the City of Jefferson,
Missouri., a municipal corporation with offices at 320 East McCarty
Street, Jefferson City, Missouri 65101 , hereinafter called the
"City" and Miller Associates Engineers, Planners and Surveyors,
Inc. , 409 Vandiver Drive, Building 5, Columbia, Missouri 65202,
hereinafter called the "Contractor".
WITNESSETH, that whereas the City of Jefferson desires to
obtain photographic and reprographic mapping for the Jefferson City
area, hereinafter called the "Project" .
AND WHEREAS, the City is authorized and empowered to contract
with the Contractor for said services for this Project;
AND WHEREAS, necessary funds for payment of said services are
available;
NOW, THEREFORE, the City hereby hires and employs the Contrac-
tor in accordance with the following:
PART A - SCOPE OF SERVICES:
General: The Contractor will furnish photographic and repro-
graphic mapping for the Project and submit it to the City for its
approval as follows:
Item One: Drafting Services
1. The Con-tractor shall draft in ink flood plain
information on the City' s Zoning Atlas. Flood plain
information to be shown is the boundaries of the 100 Year
Flood Plain, the boundaries of Flood-way and all 100 Year
Flood Elevations.
The City will furnish the Contractor with mylar
zoning atlas sheets which are at a scale of 1" = 2001 .
The City will furnish the Contractor with two
sets of flood plain maps with one set showing Flood
Plains and Floodways and the other (FIRM map) showing
Flood Elevations. These maps are at a scale of 1" = 400'
and are dark blue ink printed on white paper.
a. Drafting on Sheets North of the Missouri
River.
The City will furnish the Contractor with
eleven zoning atlas, blue line sheets (1" = 2001 ) on
which the City shall have marked in pencil four
flood elevation lines (with elevations) and one

Floodway Boundary line. It shall be the Contrac-
tor' s responsibility to ink this information on
eleven (11) mylar zoning atlas sheets (1" = 2001 ) .
b. Drafting on Sheets South of the Missouri
River.
The Contractor shall enlarge those portions of
the 1" = 400 ' scale Floodway Maps which show areas
subject to the 100 Year Flood to 1" = 2001 .
These enlargements are to be used as a guide in
inking the 100 Year Flood Plain and the Floodway on
the zoning atlas sheets. For proper alignment the
enlargements may need to be shifted slightly during
the course of the drafting process. Approximately
eleven (11) square feet of the 1" = 400' scale maps
will need to be enlarged to 1" = 2001 .
One Hundred Year Flood elevation lines and
elevations are to be drafted on the same zoning
atlas sheets. This information is to be taken from
1" = 400' FIRM maps furnished by the City. Transfer
of the information from 1" = 400' to 1" = 200' is to
be by scaling or enlargement.
Drafting is to be performed on 14 zoning atlas
dft sheets. "Flood Plain" is to be lettered 40 times
and "Floodway" is to be lettered 20 times on the 14
atlas sheets at locations designated by the City.
2. Draft in ink twelve (12) changes in zoning
district boundaries and forty (40) street name changes.
The City will furnish the necessary zoning atlas mylar
sheets and a marked set of paper prints. The mylar
sheets and the marked paper prints will both be at a
scale of 1" = 200' . The zoning change, date of change
and the ordinance number making the change are to be
lettered in the space provided for this purpose on each
of the twelve atlas sheets. This information is to be
provided by the City.
PART B. TIME OF PERFORMANCE:
The Contractor shall complete all work items specified in Part
A above within ninety (90) calendar days after the notice to
proceed.
PART C. METHOD OF COMPENSATION:
As soon as the work has been satisfactorily completed the
Contractor will submit to the City one billing for the services
AM performed. Compensation for the services described in the scope of

work shall be a lump sum amount of Two Thousand Nine Hundred and
Ninety Two Dollars ($2, 992.00) .
PART D. OWNERSHIP OF MATERIALS:
The City shall be the owner of all work produced under this
Contract.
PART E. SUBLETTING, ASSIGNMENT OR TRANSFER:
The Contractor shall not sublet, assign or transfer any
interest in the work covered by this Contract except with the prior
written consent of the City. The use of subcontractors shall in no
way relieve the Contractor from his primary responsibility for the
performance of the work.
No approval will be necessary for nonprofessional services
such as reproductions, printing, materials and other services
normally performed or provided by others.
PART F. INSPECTIONS, CONFERENCES AND APPROVALS:
Representatives of the City shall have the privilege of
inspecting and reviewing the work being done by the Contractor and
advising with him at any time. Conferences are to be held at the
request of any of the above named parties.
PART G. RESPONSIBILITY FOR CLAIMS AND LIABILITY:
The Contractor shall indemnify and save harmless the City from
all claims or suits made or brought for injury to persons or
property caused by the negligent acts of the Contractor, its
agents, employees or subcontractors in the execution of the work.
PART H. DISPUTES AND REMEDIES:
Except as this agreement otherwise provides, all claims,
counterclaims, disputes and other matters in question between the
owner and engineer arising out of or relating to this agreement or
the breach of it will be decided by arbitration if the parties
whereto mutually agree, or in a court of competent jurisdiction
within the State in which the owner is located.
PART I. TERMINATION OF THE CONTRACT:
The City may cancel this Contract or any part thereof at any
time by giving written notice to the Contractor at least fifteen
(15) calendar days prior to the effective date of the termination.
The Contractor shall be paid for the value of all acceptable work
performed prior to the effective date of termination based on the
payment terms of the Contract. Payment shall not exceed the total
amount encumbered under this Contract, except as may have been
previously amended in accordance with supplemental agreements.

It is not contemplated that the Contractor shall have any
right of termination other than for such cause as has been estab-
lished as sufficient at law.
PART J. COMPLIANCE WITH LAWS:
The Contractor shall comply with all Federal , State and Local
laws, ordinance and regulations applicable to the work. He shall
secure all licenses, permits, etc. , from public and private sources
necessary for the fulfillment of his obligations under this Con-
tract.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed as of the day and year first above writ-
ten.
