ORDINANCE NO. l0'JIQ-
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING 4.96 ACRES LOCATED SOUTH OF THE
MAIN BRANCH OF WEARS CREEK AND WEST OF DIX ROAD FROM C-2 (GENERAL
COMMERCIAL) TO RC (CONSERVATION).
WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING
CODE RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH,
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
SECTION 1. The following described real estate is rezoned
from C-2 (General Commercial) to RC (Conservation) :
Part of the East half of the northeast quarter of Section
11, Township 44 North, Range 12 West, City of Jefferson,
Cole County, Missouri, being the southerly part of a tract
previously described in Brook 272, Page 560 of the Cole
AOL County Records, said southerly part described as follows:
Beginning at the southeast corner of the Northeast quarter
of said Section 11; thence S 850 58 ' 521" W, along the
quarter Section line, 716.00 feet to the southeast corner of
a tract as per Book 163, Page 298; thence N 050 17' 47" W,
along the east line of said tract, 109 .00 feet to the
northerly line of the tract as per Boob 272, Page 560;
thence in a northeasterly direction along the northerly line
of the tract last mentioned on the following courses: N 470
59' 10" E, 126.20 feet; thence N 520 35' 09" E, 84.69 feet;
thence N 560 27' 31" E, 94.83 feet; thence N 70° 37' 39" E,
107. 54 feet; thence N 80" 36 ' 27" E, 97.22 feet; thence N
690 30' 16" E, 64.58 feet; thence N 440 13 ' 351" E, 60.57
feet, to a point on the west line of the tract last
mentioned, said point being 361 . 10 feet south from the
northwest corner of said tract: thence from said point and
leaving the northerly line of said tract, N 470 51 ' 441" E,
197.37 feet to the east line of said Northeast quarter of
Section 11; thence S 040 21' 01" E, along the Section line,
498.08 feet to the point of beginning. Containing 4.9661
acres.

STAFF REPORT
ON THE
REQUEST TO REZONE PROPERTY AT DIX ROAD AND WEARS CREEK
AND
A REPLAT OF CERTAIN LOTS IN
PRIMROSE VALLEY ESTATES, SECTION IV
RE: Request submitted by Willard W. and Lenora E. Manning
to rezone 4 .96 acres located south of the Main Branch
of Wears Creek and west of Dix Road from C-2 (general
commercial) to RC (conservation) .
AND
Request submitted by Willard W. and Lenora E. Manning
for approval of a .replat and addition to Lets 33, 34 ,
41 and 42 of Primrose Valley Estates, Section IV.
The Mannings purchaseed the 4 .96 acres to obtain access to
the City sanitary sewer for their residential subdivision to the
IV south. Since the Mannings do not want to develop or continually
own the 4 .96 acres, they would like to make it parts of four
existing residential lots.
The Mannings first requested the property be rezoned from
commercial to single family residential. The owners of adjacent
commercial property objected to the request for residential
zoning. They did riot want residential zoning that close to their
commercial properties . The Mannings, therefore, changed their
request to have the property rezoned to be in the RC
(conservation) District. No structures can be erected in the
Conservation District .
The Planning Commission, by unanimous vote, recommends : ( 1)
the request to rezone to RC be approved, and (2 ) the replat be
approved. The rezoning request and the replat encompass the same
area.
