AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING THE NORTHWEST CORNER OF NEW STATE
HIGHWAY ROUTE C AND VIETH DRIVE FROM RS-2 ( SINGLE-FAMILY
RESIDENTIAL) TO C-1 (NEIGHBORHOOD COMMERCIAL) .
WHEREAS, IT APPEARS THAT THE PROCEDURES SET FORTH IN THE ZONING
CODE RELATING TO ZONING HAVE IN ALL MATTERS BEEN COMPLIED WITH,
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
SECTION 1. The following described real estate is rezoned
from RS-2 ( Single-Family Residential ) to C-1 (Neighborhood
Commercial) '
Part of the Southwest quarter of the Northeast quarter of
Section 23, Township 44 North, Range 12 West, in the City of
Jefferson, Missouri, more particularly described as follows:
® From a point on the south line of the Southwest quarter of
the Northeast quarter of said Section 23, 100 feet east of
the southwest corner -thereof: thence North parallel with
the quarter Section line, 1044 feet to the southerly line of
Southridge Drive formerly Route "C" formerly U.S. Route 54;
thence N 680 30 ' E, along the southerly line of said
Southridge Drive, 53 feet to the northeasterly corner of a
tract conveyed to Mary Ellen Lee and Donna Carol Lee, by
deed of record in Book 224, Page 991, Cole County Recorder's
Office, and the beginning point of this description; thence
southerly along the easterly line of said Lee tract to the
northerly right-of-way line of Supplementary State Highway
Route "C"; thence northeasterly and northwesterly along the
right-of-way line of said Route and its connection to
Southridge Drive to the southerly line of said Southridge
Drive; thence westerly along the southerly line of said
Southridge Drive to the beginning point of this description.
SECTION 2. This ordinance shall be in full force and effect
from . and after its passage and approval.

STAFF REPORT
ON THE
REZONING OF PROPERTY AT ROUTE C AND VIETH DRIVE
RE: Request submitted by Fred W. and Ethel M. Schuricht to
rezone the northwest corner of New State Highway Route
C and Vieth Drive from RS-2 (single-family residential)
to C-1 (neighborhood commercial) . This tract is
bounded on the north by Southridge Drive (Old State
Highway Route C) .
There are single family dwellings on the two lots to the
west of the Schuricht tract. Further to the west are multi-
family dwellings in an RA-2 zoning district. Lands to the north,
east and south of the tract are either right-of-way or. vacant
land in an RS-2 (single family) district. The southeast corner
of the Route C/Idlewood Drive is zoned M-1 ( light industrial) .
Part of this M-1 land is owned by the Phillips Pipeline Company.
The tract is bounded on the south by Route C and on the east
and north by well-traveled streets . It is not a good location
for a single family dwelling.
If the tract is used for commercial purposes , it should not
create traffic problems at the Route C/Vieth Drive intersection
since the only access to the property is from Southridge. it
could create problems at the Southridge/Vieth Drive intersection
due to poor sight distance and high traffic volume.
The site cannot feasibly be served by sanitary sewer. The
Plumbing Inspector states that on-site treatment would be
feasible for a small business .
The Comprehensive Plan designates this area as multi-family.
If the area is zoned commercial, it would be a case of spot
zoning. The owner of the second single-family dwelling to the
west of the proposed rezoning objected to the request at the
Planning Commission hearing.
By a vote of 4 to 3, the Planning Commission recommends that
this request for rezoning be approved. The tract, if rezoned, is
to be used for a convenience store.
