AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1122-08 AND THE FISCAL YEAR 2008-09 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 1122-08 on September 9, 2008, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2008-09; and WHEREAS, changed conditions and circumstances which could not have been foreseen through the use of reasonable diligent thought and attention, necessitated the adoption of Ordinance No. 1130-08 on December 9, 2008; Ordinance No. 1141-09 on April 28, 2009; Ordinance Number 1145-09 on July 14, 2009; and Ordinance No. 1154-09 on August 25, 2009 amending the budget adopted by Ordinance No. 1122-08; and WHEREAS, a public hearing on the following amendment to the fiscal year 2008-09 budget contemplated has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE • CITY OF RICHLAND HILLS, TEXAS: I. That Section VI of said Ordinance No. 1122-08 as amended be amended appropriating $286,718 out of the 1998 Certificate Obligations Interest and Sinking Fund for the repayment of wastewater works long term debt principal and interest. II. That Section VII of said Ordinance No. 1122-08 as amended be amended appropriating $154,203 out of the 2007 Waterworks Revenue Bond Interest and Sinking Fund for the repayment of water and sewer works long term debt principal and interest. • • III. That Section VIII of said Ordinance No. 1122-08 as amended be amended appropriating $66,619 out of the 2005 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. IV. That Section X of said Ordinance No. 1122-08 as amended be amended appropriating $50,267 out of the 2007 Contractual Obligation Interest and Sinking Fund for the repayment of general long term debt principal and interest. V. That Section XI of said Ordinance No. 1122-08 as amended be amended appropriating $348,011 out of the Drainage Utility Fund for drainage system improvements in accordance with the City's drainage ordinance and state law. VI. That Section XV of said Ordinance No. 1122-08 as amended be amended • appropriating $13,800 out of the Municipal Court Technology fund for the purpose of capital equipment and assets. VII. That Section XVI of said Ordinance No. 1122-08 as amended be amended appropriating $125,344 out of the 2001 Certificate Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. VIII. That Section XVII of said Ordinance No. 1122-08 as amended be amended appropriating $135,114 out of the Equipment Replacement Fund for the purchase of Capital Assets. IX. That Section XVIII of said Ordinance No. 1122-08 as amended be amended appropriating $51,761 out of the Facilities Improvement Fund for the purpose of remodeling police briefing room, installing carpet and the in the police station and replacing the roof and air conditioning units atop the community • center building. • X. That Section XIX of said Ordinance No. 1122-08 as amended be amended appropriating $498,189 out of the Crime Control and Prevention District Expense Fund for the purpose of acquiring capital assets and equipment and supporting crime reduction programs throughout the City. XI. That Section XXI of said Ordinance No. 1122-08 as amended be amended appropriating $321,133 out of the TOD THE Grant Expense Fund for the construction of sidewalks connecting to the THE Station. XII. That Section XXIII of said Ordinance No. 1122-08 as amended be amended appropriating $14,559 out of the Library Donation Fund for the purchase of capital equipment and assets. XIII. That Section XXIV of said Ordinance No. 1122-08 as amended be amended appropriating $12,935 out of the Animal Shelter Donation Fund for the • purchase of capital equipment and assets. XIV. That Section XXVI of said Ordinance No. 1122-08 as amended be amended appropriating $37,500 out of the Baker Boulevard TIF Fund for the completion of a Tax Increment Finance District evaluation. XV. That Section XXVIII of said Ordinance No. 1122-08 as amended be amended appropriating $321,133 out of the Traffic Safety Fund for the purpose of constructing traffic quieting pavement improvements, crash construction equipment and payment of fees to the State of Texas. XVI. That Section XXXI of said Ordinance No. 1122-08 as amended be amended appropriating $33,841 out of the School Resource Officer Fund for the purpose of providing police services to the school district. • • XVII. That Section XXXI-A be created in said Ordinance No. 1122-08 as amended be amended appropriating $125 out of the Capital Projects Funds for the purpose of constructing water system improvements. XVIII. That Section XXXI-B be created in said Ordinance No. 1122-08 as amended be amended appropriating $175 out of the Law Enforcement Fund to purchase equipment for the Police Department. XIX. That Section XXXI-C be created in said Ordinance No. 1122-08 as amended be amended appropriating $$6,300 out of the Library Grants TIF Fund for the purchase of computers and equipment for the Library. XX. That Section XXXI-D be created in said Ordinance No. 1122-08 as amended be amended appropriating $105,536 out of the Oil and Gas Fund for • the construction of system improvements to accommodate gas well drilling. XXI. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XXII. Saving Clause. That said ordinance No. 1122-08 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. • • XXIII. Effective Date. This ordinance shall be in full force and effective from and after its passage. XXIV.
