ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE JEFFERSON
CITY AREA HOUSING AUTHORITY FOR THE CONSTRUCTION OF THE JOSEPH M.
CLARKE SENIOR CENTER.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
. Section 1,. The Mayor and City Clerk are hereby authorized
to enter into an agreement with the Jefferson City Area Housing
Authority for the payment by the City to the Housing Authority
the sum of Two Hundred Thousand Dollars ( $200,000) for the
construction of the "Joseph M. Clarke Senior Center. "
Section 2. This agreement shall be substantially the same
in form and content as Exhibit A attached hereto.
Section 3. This ordinance shall be in full force and effect
from and after the date of its passage and approval.

by and between the City of Jefferson, Mis ' uri, municipal
corporation, acting by and through its Mayt and L ty Clerk,
(hereinafter referred to as "City" ) and the Housing Authority of
the City of Jefferson, Missouri, a municipal corporation
(hereinafter referred to as "Authority" ) .
WI iNESSETH:
WHEREAS, the City is supportive of activities that promote the
health, happiness and welfare of the senior citizens of the City
of Jefferson; and
WHEREAS, the Housing Authority of the City of Jefferson was
formed in part for the purpoee of performing services and
functions for the senior citizens of the City of Jefferson; and
WHEREAS, the City as trustee for the public use of certain
proceeds from the sale of property granted to the City by the
will of Joseph M. Clarke wishes to carry out the terms of that
will and in so doing honor the memory of Joseph M. Clarke; and
WHEREAS, pursuant to Court Order, the City wishes the proceeds
for the sale of the property for the public use be dedicated to
the senior citizens of the City of Jefferson; and
WHEREAS, the Council of the City of Jefferson, Missouri, has by
ordinance authorized the execution of this contract on behalf of
the City;
NOW, THEREFORE, it is agreed as follows:
1 . The City agrees to pay to the Authority the sum of Two
Hundred Thousand Dollars ($200,000) ; as follows:
a. One Hundred Thousand Dollars ($100,000) shall be paid to
the Authority on the delivery to the City of documents
representing the agreements which the Authority has entered into
for the construction of the improvements; and
b. One Hundred Thousand Dollars ($100,000) to be paid to
the Authority five ( 5 ) days after the commencement of
construction;
2. The Authority agrees to name the improved structure the
"Joseph M. Clarke Senior Center" (hereinafter referred to as
"Center" );
3. The Authority agrees that the Center shall be open to the
public;
4. The Authority agrees that it will in all other respects
comply with the Court Order directing that the proceeds from the
sale of the property granted by the will of Joseph M. Clarke to
the City be put to public use;
5. The Authority agrees that if operations of the property as
the Joseph M. Clarke Senior Center cease within fifteen (15)
years of the date hereof, the Authority shall repay to the City
the sums dedicated for the Center under this Agreement.
