APPROVING PROGRESS PAYMENT ESTIMATE NO. 7
& CHANGE ORDER #2
2018 ROAD IMPROVEMENT PROGRAM
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a
contract to S Brothers, Inc. in the amount of $2,747,521.00 for the 2018 Road
Improvement Program; and
WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has
advised the Governing Body that a modification of the contract is reasonable and
necessary and has recommended that the aforesaid contract be modified in accordance
with Progress Payment Estimate #7 & Change Order #2 (see attached); and
WHEREAS, Progress Payment Estimate No. 7 & Change Order 92 include a change in
the description of work and /or to decrease quantities to reflect as -built conditions, and to
provide for certain supplementary items; and
WHEREAS, Change Order 42 provides for a net increase in the contract price in the
amount of $206,808.84, resulting in a revised contract price of $3,188,544.74 including
all previously approved change orders; and
WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the
above described changes and /or modifications to the project were unforeseen at the time
of the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
1. That Progress Payment Estimate No. 7 & Change Order #2
attached hereto and made a part hereof, resulting in a net increase
of $206,808.84 and resulting in a revised contract price of
$3,188,544.74 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to
execute Progress Payment Estimate No. 7 & Change Order #2, and
issue payment thereon, based upon the recommendation of the
Borough Engineer and subject to attorneys review of the
maintenance bond.

3. A copy of this resolution and a fully executed copy of Progress
Payment Estimate No. 7 & Change Order #2 be forwarded to the
Borough's Purchasing Department and CME Associates for
'distribution to S. Brothers, Inc.

Dear Mayor Reiman and Borough Council:
Enclosed for your review and further handling, please find Progress Payment Estimate No. 7 and Change
Order No. 2 for the above - referenced project, as approved by this office. This estimate is in the amount
of $219,641.60. The estimate is for work completed by S. Brothers, Inc. through August 2020, which
includes payment for milling, paving, and parking lot improvements at the Municipal Library as well as
various streetscape repairs.
Change Order No. 2 results in an overall increase in contract value, from an adjusted amount of
$2,981,735.90 to an adjusted amount of $3,188,544.74. The increases and decreases in contract
quantities could not, in our opinion, have reasonably been effectuated by a separately bid contract without
unduly disrupting the basic work and imposing adverse consequences on the Borough and will provide an
improved level of service to the Borough and the residents.
Certified Payroll Reports shall be provided by the Contractor under separate cover.
