AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING THE
RULES AND REGULATIONS OF THE POLICE PERSONNEL BOARD PURSUANT TO
SECTI0N 24-48 OF THE CODE OF THE CITY OF JEFFERSON.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. Pursuant to Section 24-48 of the Code of -the
City of Jefferson, the Rules and Regulations of the Police
Personnel Board are hereby adopted.
Section 2. The Rules and Regulations of the Police
Personnel Board shall be substantially the same in form and
content as the Rules and Regulations attached hereto as Exhibit
A.
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

RULES AND REGULATIONS
OF THE
JEFFERSON CITY POLICE PERSONNEL BOARD
Pursuant to the authority of Section 24-48 of the Code of
the City of Jefferson, Missouri, the Police Personnel Board
hereby adopts they following Rules and Regulations governing its
operation

RULE 1: OFFICERS
The Board shall elect from its members a chairman, vice-
chairman, and secretary. The chairman shall preside over all
meetings of the Board and shall act as the official spokesperson
for the Board. The vice-chairman shall act on behalf of -the
chairman in all instances when the chairman is not in attendance
at any meeting of the Board or is otherwise unable to perform his
or her duties. The secretary shall keep all records of the
Board, including recording minutes of all Board meetings.
Officers shall serve one-year terms and shall serve until a
successor is duly elected and qualified. Officers shall be
elected at the first meeting in January of each year. Officers
shall assume their respective duties immediately upon election.

RULE 2: MEETINGS
Meetings shall be held the first Thursday of every month and
at such other times as are necessary for the Board to operate
efficiently. Board meetings shall commence at 7:00 a.m. or at
such other time as the Board may agree.
RULE 3: QUORUM
At least four members of the Board must be present at the
beginning of a meeting in order for a quorum to be deemed
present.
RULE 4: MAJORITY VOTE
® A majority vote of those members present at any meeting at
which a quorum is present shall be required to pass any issue
presented to the Board.
RULE 5: FREQUENCY OF EXAMINATIONS
Examinations for police officer and communications officer
shall be conducted twice yearly the third Saturday in February
and the third Saturday in August. Examinations for police
officer and communications officer may be conducted at other
times if the Board determines that additional examinations are
necessary in order for eligibility lists to be supplemented.
Examinations for establishment of promotional registers or other
employee registers shall be held at such times as the Board is
notified by the Mayor or Chief of Police of the need for
supplementation of such registers.
RULE 6: EXAMINATIONS
Examinations for establishment of eligibility or promotional
registers shall consist of open, competitive written and oral
examinations and may include skill tests, such as typing,
shorthand, etc. Such examinations shall be designed to determine
objectively the relative qualifications of applicants for
employment or promotion. The Board is authorized to delegate
testing of skill levels to public or private testing agencies..
RULE 7: NOTIFICATION OF EXAMINATIONS
The Board shall give public notice of each open, competitive
employment and promotional examination by publishing the game in
a newspaper of general circulation in the City of Jefferson,
first publication being a minimum of fifteen ( 15) days prior to
the written examination. The notice shall be published a minimum
of three times per week for two weeks. The Board shall give such
other notice as it deems necessary, including the posting of
notice of promotional examinations in the Police Department
Building.
RULE 8: COMPLETION OF APPLICATION
Any person desiring to participate in any employment or
promotional examination shall complete an application therefor on
a form to be provided by the Board. Failure to complete fully an
applicant shall result in the applicant being refused permission
to participate in any testing. Applications for admission to
examinations must be received in the City Clerk's office no later
than ninety-six ( 96) hours prior to the commencement of the
examination.
RULE 9: ADMISSION TO EXAMINATIONS
Prior to admission to any examination, applicants shall
furnish positive proof of identification. Only persons who have
submitted timely applications as provided in Rule 8 shall be
admitted to the examination.
RULE 10: WAIVER OF CERTAIN RULES
The Board, in its discretion, for good cause shown, may
® allow an applicant for employment or promotion to take the

written examination at a time other than that scheduled. In the
event an applicant is permitted to take an examination at other
than the published time, the Board ehall impose such conditions
as will insure that the contents of the examination are kept
strictly confidential.
RULE 11: CRIMINAL INVESTIGATION
Every applicant for employment and promotion shall be
subject to a criminal history check, said computer check to be
conducted by a police officer designated for that purpose by the
Chief of Police. The results of such computer check shall be
reported by the designated officer solely to the Hoard. The
Board may reject the application of any person if the board finds
that the applicant ' s criminal history as disclosed by the
computer check renders the applicant unfit for the position
sought . Computer checks shall be conducted prior to
administration of oral examinations. In the event the Board
rejects the application of any person based upon said person's
criminal history as disclosed by the computer check, the board
shall immediately notify such person in writing of the rejection
of his or her application and shall inform the applicant of the
reasons therefore. After the applicant's name is placed upon an
eligibility or promotional register, the applicant shall be
subject to such additional background investigation as the
appointing authority deems necessary or advisable in making an
informed decision concerning appointment or promotion.
RULE 12: DISQUALIFICATION FOR DECEPTION
The Board may reject the application of any person and may
terminate any further processing of an application if it finds
that the applicant has knowingly made a false statement of fact
in his or her application or has attempted to practice any fraud
or deception in his or her application or examination. In the
event the Board rejects an application or terminates its further
processing as provided herein, the Board shall immediately notify
the applicant in writing of such rejection or termination
together with the reasons therefor.
RULE 13: ORAL EXAMINATION
The Board shall conduct oral examinations of all persons
achieving a passing grade on the written examination, said oral
examination being designed to test objectively the relative
qualifications of applicants.
RULE 14: ESTABLISHMENT OF PASSING GRADE
In order for an applicant' s name to be placed upon an
eligibility or promotional register, the applicant must obtain a
minimum score of 80 on both the written and oral examinations,
said score to be based upon a scale of from 0 to 100.
RULE 15: RATING OF EXAMINATIONS
The written and oral examinations shall each constitute
fifty percent ( 50$) of applicants final rating.
RULE 16: VETERAN'S PREFERENCE
An honorably discharged veteran of any branch of service in
the armed forces of the United States, who has met all other
requirements for eligibility, shall be given an additional credit
of five (5) points on his or her oral examination score.
RULE 17: CREDIT FOR EXPERIENCE
Any presently certified peace officer as defined in Chapter
590 of the Revised Statutes of Missouri, who has met all other
requirements for eligibility, shall be given an additional credit
of five (5) points on his or her oral examination score.
RULE 18: ADDITIONAL CREDIT LIMITATIONS
Rules 16 and 17 shall not apply in the establishment of
promotional registers.
RULE 19: NOTIFICATION OF RESULTS
Every person completing an examination shall be notified
within forty-five (45) days whether he or she passed or failed
the examination.
RULE 20: APPLICANT MUST PASS WRITTEN AND ORAL EXAM
In order for an applicant' s name to be placed upon an
employment or promotional register, the applicant must pass both
the written and oral examinations and further must meet any
minimum skill level established by the Hoard.
RULE 21: REGISTERS
A single register shall be maintained by the Board for each
of the following positions:
1. Administrative Secretary
2. All other civilian employees
3. Police Reserve Officer
4. Police Officer
5. Communications Operator
6. Sergeant
7. Lieutenant
S. Captain
9. Chief of Police
An applicant's name, once placed on the register, shall remain on
the register for one (1 ) year. At the expiration of said year,
such applicant ' s name shall be removed from the applicable
register. Registers shall be maintained in alphabetical order
and test scores shall be recorded beside the name of each person
on each register. Test scores shall be reported on registers by
listing ( 1 ) written examination scores; (2) oral examination
scores; and (3) total scores.
RULE 22: BOARD MEMBERS AT TESTS
At least two (2) members of the Board shall be present for
supervision of written examinations. At least four (4) members
shall be present to conduct oral examinations.
RULE 23: RULES SUBJECT TO TEMPORARY SUSPENSION
If the Board finds that an emergency exists requiring

suspension of some or all of the above rules for a temporary
period, such rules may be suspended upon approval of such
suspension by the City Council.
RULE 24: APPEALS
Any member of the Police Department who is demoted,
suspended, or discharged may appeal in writing to the Board,
within thirty (30) days after the effective date of such action,
setting forth his or her reasons for claiming this demotion,
suspension or discharge was not for good cause or for the good of
the department. Upon such action the Board shall within ten ( 10)
days hear the appeal, and the appellant, chief of police, and the
appointing authority shall have the right to be heard in person,
to be represented by counsel and to present evidence at such
hearing, which shall be a public hearing at the request of
appellant. Technical rules of evidence shall not apply at such
hearing. Upon consideration of the evidence and within fifteen
(15) days of the conclusion of the hearing, the Board shall
approve or disapprove the action appealed from, and in the event
of disapproval, the Board shall order the appellant reinstated to
his former position and payment of such salary as was lost to the
appellant by reason of such demotion, suspension or discharge.
Any disciplinary action shall not be stayed by virtue of an
appeal to the Board. All proceedings at a hearing as provided
herein shall be duly recorded by stenographic or electronic
AML recording.
RULE 25: AMENDMENT OF RULES
These rules may be amended by majority vote of the Hoard at
any meeting at which a quorum is present, which amendments are
not effective until approved by the City Council.
