AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR UTILITY PURPOSES OVER LAND LOCATED IN THE
CITY OF JEFFERSON, MISSOURI.
WHEREAS, by an easement dated on the 6th day of June 1986,
and recorded in Book 293, page 706, of the Records of Cole
County, Missouri, a utility easement was granted to the City of
Jefferson, Missouri, a municipal corporation, to build,
construct, keep and maintain a sanitary sewer in, under and
through the lots, tracts or parcels of land described in Section
1;
NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described
easement is surplus property of the City and is no longer needed
for any public purpose:
Part of the Southwest Quarter of the Northwest Quarter
of Section 11, Township 44 North, Range 12 West, being
more particularly described as a strip of land 10 feet
wide, lying 5 feet each side of and parallel to the
following described centerline:
From the Southeast corner of the Southwest Quarter of
the Northwest Quarter of said Section 11; thence N 050
38' 12" W, along the Quarter Quarter Section Line,
204.90 feet; thence S 84° 21. 0 48" W, 252. 85 feet;
thence N 060 21' 42" W, 152.23 feet; thence N 220 05'
22" W, 400.00 feet to the point of beginning of this
centerline description; thence N 440 00' 48" E, 295.09
feet; thence N 850 45' 00" E, 20.00 feet to the point
of termination.
ALSO, an easement of an even width of 15 feet upon the
land located immediately adjacent to each side and
extending the full length of the 10 foot strip of land
described above, for the initial construction and
installation of the aforementioned sanitary sewer
facilities; provided that this additional easement
shall expire and terminate upon completion of said
sewer.
Section 2. The easement described in section 1 is hereby
relinquished, and the City does hereby release and abandon
whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized
to execute any necessary Legal document relinquishing all of the
City's interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect
from and after its passage and approval.
