AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 24 BY AMENDING SECTION 24-41 AND BY REENACTING SECTIONS 24--27 AND 24-46, PERTAINING TO THE POLICE PERSONNEL BOARD PROCEDURES, ORGANIZATION AND RESPONSIBILITIES. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 24 is hereby amended by amending Section 24-41 to read as follows: Section 24-41. Members. (a) The police personnel board shall be composed of six (6) members, not more than one-half of whom shall be members of the same political party. Members of the board shall be appointed by the Mayor with the consent of a majority of the members of the City Council. Every year two (2) members shall be appointed for a term of three (3) years. The Mayor, with the consent of a majority of the members of the City Council, shall fill vacancies for any unexpired term. The Mayor may, by and with the consent of the City Council, remove any member for misconduct or neglect of duty. Members of the board shall serve until their successors shall have been appointed and qualified, unless removed for misconduct or neglect of duty. (b) Each member of the police personnel board shall be a resident of the City for at least two (2) years immediately prior to his appointment. Members of any official political party committee shall not be eligible for membership on the board. Members of the board shall be required to take the oath of office prescribed by provisions of the Code or other ordinances for city officers, including a statement that they are in sympathy with the merit principle as it relates to the city police department. (c) Board members shall serve without compensation. Section 2. Sections 24-27 and 24-46 were inadvertently omitted from Ordinance No. 10725 amending the procedures, organization and responsibilities of the police personnel board. The Council of the City of Jefferson, Missouri, declares that Sections 24-27 and 24-46 have been and remain in full force and effect and are included herein and reenacted for clarification ® purposes. Sections 24-27 and 24-47 read as follows: Section 24-27. Prohibited acts and practices. (a) No member of the police department or applicant seeking a position therein shall be appointed, promoted, demoted, favored or discriminated against because of his race, a (b) No person shall wilfully or corruptly make any false statement, certificate, mark or report in regard to any examination, certification or appointment held or given under the provisions of this article, or in any manner commit or attempt to commit any fraud preventing the impartial execution of the provisions of this article or of any rules and regulations made thereunder. (c) No member of the police department shall continue in such position after becoming a candidate for nomination or election to any public office, unless he resigns or obtains a leave of absence from his position in the department. (d) No person seeking appointment to or promotion in the police department shall, either directly or indirectly, give, render or pay any money, service or other valuable thing to any person for, on account of or in connection with his examination, appointment, proposed appointment, promotion or proposed promotion. (e) No person shall use or threaten to use any influence, persuasion or coercion to compel or attempt to compel any member of the police department to violate any provision of this section. (f) No person shall use or promise to use, directly or indirectly for any consideration whatsoever, any official authority or influence to secure or attempt to secure for any person an appointment or advantage in an appointment to any position in the police department or any increase in pay, promotion or other advantage in the department. (g) Any member of the police department who violates any provision of this section shall., upon conviction therefor, forfeit his position as a member of the department. Section 24-46. Oaths and subpoenas. Any member of the police personnel board, on behalf of the board, shall have power to administer oaths, subpoena witnesses and compel the production of books and records relevant to any investigation or hearing authorized by the article. Attendance of witnesses may be compelled by attachment if necessary. Persons who fail to produce books r and records subpoenaed by the board or who fail to testify without lawful cause or who testify falsely shall be deemed guilty of a misdemeanor. Section 3.
