ZQF6 7 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING A PORTION OF A PUBLIC ALLEY LOCATED BETWEEN INDIANA AVENUE AND MINNESOTA AVENUE. WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the owners of land adjacent to and abutting upon the east-west alley between Indiana Avenue and Minnesota Avenue in the City, has petitioned the City Council to vacate right-of-way as a public alley; and, WHEREAS, it has further been shown that it would not inconvenience the public or the citizens of the City to discontinue as a right-of-way for a public alley such alley as described in Section 1 of this Ordinance, subject to a reservation in the City of an easement in that portion vacated for the maintenance, repair, location and relocation of all sanitary sewer, surface water sewer or public utility facilities now existing or hereafter to be constructed within said right-of- way: NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, hereby declares it necessary, reasonable and proper to discontinue as a right-of-way for a public alley and forever vacate -the following described alley in said City, subject to the reservation in the City of the easement mentioned in Section 2 of this Ordinance: All that part of a 20 foot wide east-west alley in Block 14 of Washington Park Addition described as follows: Beginning at the southeast corner of Lot 1 thence westerly along the southerly line of Lots 1 through 15 to the southwest corner of Lot 15; thence southerly 20 feet along the extension of the westerly line of Lot 15 to the northeast corner of Lot 30; thence easterly along the northerly line of Lots 16-30 to the northeast corner of Lot 16; thence northerly 20 feet along the extension of the easterly line of Lot 16 to the point of beginning. Section 2. All of that portion of the above vacated property is hereby retained as a perpetual easement or right-of- way for the construction, maintenance, repair, relocation and operation of sanitary sewers, surface water drainage, and all public utility facilities, and no permanent buildings or structures shall be located within or upon said easement without P the prior written consent of the City. Section S. The statutory right of reversion in the owners of the abutting property is hereby confirmed, subject to the easement expressly reserved in Section 2 of this Ordinance, as is provided by the laws of the State of Missouri, and the Mayor and the Clerk of the City are hereby authorized to execute all necessary instruments required to confirm the reversionary rights of the owners of property abutting on the area vacated, as described in Section 1 of this Ordinance, in the right-of-way vacated. Section 4. This Ordinance shall be in full force and effect from and after its passage and approval. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized and directed to execute a contract with Williams-Keepers Certified Public Accountants for the audit of the City records for the year ending October 31, 1987, for a sum not to exceed $15,300. Section 2. The contract shall be substantially the same in form and content as that contract attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed Approved 9 Presl.d Officer Mayor ATTEST: City Clerk PERSONAL SERVICES CONTRACT This Contract is made and entered into the day of 1987, by and between the City of Jefferson, Missouri, a Whic0al corporation, hereinafter referred to as "City" , and Williams- Keepers Certified Public Accountants, a partnership, hereinafter referred to as "Auditor" . In consideration of the covenants and agreements hereinafter set forth, it is agreed as follows: 1. Auditor will perform auditing services for the City as described in the Audit Proposal, which is attached hereto as "Exhibit A", and incorporated herein. 2. At any point during the audit, if the Auditor encounters any unusual situation which indicates that the audit cannot be completed without increasing the scope of this agreement, the Auditor will immediately notify the City of that situation. 3. The final copy of the audit will be submitted to the Finance Director by February 10, 1988, with the audit delivered to the City Council on February 15, 1988. 4. The Auditor will hold a pre-audit conference with the City staff and a second pre-audit conference with the federal cognizant agency. 5. The Auditor will hold an exit conference with City staff. 6. The City will pay the Auditor a total sum of $15,300 for the auditing services. This will be paid 75% after acceptance by the City Council and 251% after acceptances by the cognizant agency. The City will not pay the Auditor any additional amounts either for the services described in this agreement, or for any services outside the scope of this contract without the prior written consent of the City Council, whether or not the Auditor had performed any additional services. 7 . The Auditor is an independent contractor and nothing contained in this contract or its attachments shall constitute or designate the appraiser or any of its officers, agents, or employees as agents of employees of the City.
