AN ORDINANCE RELINQUISHING A CERTAIN EASEMENT FOR SANITARY SEWER
PURPOSES IN FOX RIDGE SUBDIVISION IN JEFFERSON CITY, MISSOURI.
WHEREAS, by an easement dated May 7, 1985, and recorded in
Book 287, Page 437, of the Records of Cole County, Missouri, a
sewer easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and
repair structures for the routing and conveyance of sewer in,
under and through the lots, tracts or parcels of land described
in Section 1;
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described
easement is surplus property of the City and is no longer needed
for any public purpose:
A strip of land 10.0 feet of even width across a part of the
northeast quarter of Section 23, Township 44 North, Range
3.2, in the City of Jefferson, Missouri; the centerline of
said 10. 0-foot strip of land being more particularly
described as follows:
From the most southeasterly corner of Lot 12 of Fox Ridge
Subdivision, in the City of Jefferson, Missouri, per plat of
record in Plat Book 9, page 55, Cole County Recorder's
Office; thence north 04 degrees 01 minute 18 seconds west
along the east line of said Lot 12, 5.0 feet; thence
deflecting to the right 74 degrees 15 minutes, 4.5 feet;
thence deflecting to the left 11 degrees 00 minutes, 135.0
feet to the beginning point of this description; thence
continuing along said deflection 40.0 feet to the point of
termination of this description.
Section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon
whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized
to execute any necessary legal document relinquishing all of the
City's interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect
from and after passage and approval.
