HomeMy Public PortalAboutORD10921 BILL NO. 37-115 SPONSORED BY COUNCILMAN BORGMEYER ORDINANCE NO. f Asa/ AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERGOVERNMENTAL COOPERATIVE AGREEMENT WITH THE STATE OF MISSOURI AND THE HOUSING AUTHORITY FOR WORK INVOLVED WITH THE WEST MAIN STREET BRIDGE. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized and directed to execute a Intergovernmental Cooperative Agreement with the State of Missouri and the Housing Authority for work involved with the West Main Street Bridge project. Section 2. The agreement shall be substantially the same in form and content as that attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed ��� _ $-/S�� Approved Pres Officer Mayor ATTEST: City Clerk INTERGOVERNMENTAL COOPERATIVE AGREEMENT This Agreement, entered into by and between the State of Missouri, Board of Public Buildings, acting through the Office of Administration, Division of Design and Construction (hereinafter referred to as State) , the City of Jefferson (hereinafter referred to as City) and the Jefferson City Housing Authority (hereinafter referred to as Authority) . WHEREAS, the City will undertake an improvement project on West Main Street in Jefferson City between the State Capitol and Bolivar Street; and WHEREAS, the project will involve the reconstruction of West Main Street from the State Capitol to Bolivar Street to provide two, twelve-foot traffic lanes on either side of a six-foot median; construction of a traffic bridge over Wears Creek, four lanes in width with a center median and walks on either side; addition of street lights similar to and compatible with lights on the State parking lots at the Harry S Truman State Office Building; landscaping on both sides of the street and along all new sidewalks and curbs; low landscaping on the center median; and relocation of existing above-ground utility lines outside the street right-of-way; and WHEREAS, the contemplated improvements would enhance the approach to the Capitol from West Main Street, eliminate hazards created by the poor conditions of existing walkways, improve traffic flow and improve access to the State.':s parking garage under construction on West Main; and WHEREAS, the improvements would enhance the utility and value of property owned by the Authority in the vicinity of the project and would contribute to the Capitol West Redevelopment Project; and WHEREAS, the Board of Public Buildings has authorized the Office of Administration, Division of Design and Construction to contribute $300,000 toward the project, pursuant to a Resolution, a copy of which is attached to this Agreement as Exhibit A; and WHEREAS, the Authority has authorized the contribution of $125, 000 toward the project, as evidenced by Exhibit,.B; and WHEREAS, the City Council of the City of Jefferson has authorized the City to enter into this Intergovernmental Cooperative Agreement as evidenced by Exhibit C and; WHEREAS, the Authority now owns a strip of land adjoining the State's property and including a portion of the Wears Creek bed and bank: NOW, THEREFORE, . the parties agree as follows: ® 1. The City shall undertake to accomplish the improvements described in this Agreement to West Main Street and shall be responsible for performing or contracting for all work and ° material needed in connection with that project; 2. The plans and specifications for the improvements to West Main Street described in this agreement shall be approved by all parties prior to the letting of bids; 3. The State shall pay the City, upon the issuance of the Notice to Proceed on the reconstruction of West Main Street from the State Capitol to Bolivar Street, and the installation of the lighting and the utility relocation the sum of $150,000.00; upon the project being 50% complete the sum of $75,000.00; and upon substantial completion and after inspection and approval, the sum of $75,000; 4. The Housing Authority shall pay to the City, upon the issuance of the Notice to Proceed on the reconstruction the sum of $75,000.00; upon the project being 50% complete the sum of $25,000.00; and upon substantial completion of the utility relocation and landscaping, after inspection and approval the sum of $25.000.00; 5. The Housing Authority shall deed to the State that land it now owns which adjoins the State' s land and includes a portion of the Wears Creek bed and bank upon the payment of all sums set out in paragraph 2 by the State to the City; 6. The State shall arrange to maintain all landscaping along either side of West Main and on the center median which is installed in accordance with this Agreement through contractural arrangements between the .,..Office of Administration and the Department of Natural Resources. Cook Chairman, Board of Commissioners ATTEST: i Executive Director Secretary, Board of Commissioners BOARD OF PUBLIC BUILDINGS RESOLUTION PARTICIPATION IN THE DEVELOPMENT OF WEST MAIN STREET, JEFFERSON CITY, MISSOURI WHEREAS, the Board of Public Buildings has been authorized to allocate i funds appropriated pursuant to House Bill 15, 81st General Assembly, First Regular Session, for the construction and furnishing of the Harry S Truman Office Building, and WHEREAS, two parcels of land on the south side of West Main Street in Jefferson City and one parcel on the north side of West Main were purchased by the State for Truman Building parking lots which were constructed on these lots using Truman funds; and WHEREAS, sidewalks, street curb and gutter, street lighting and utilities on these parcels need to be provided and/or revised to accommodate the city's new West Main development plans; and 0 WHEREAS, the City of Jefferson, Missouri, the Housing Authority of the City of Jefferson, Missouri and the Cole County Highway Commission have agreed to share in their portion of the cost for the proposed development of West Main atreet,"and they are willing to enter into an inter-governmental agreement; and WHEREAS, the State's portion of the development costs along the Truman parking lots is $900,000; and WHEREAS, the Director of the Division of Design and Construction is responsible for the construction of all facilities and improvements at the seat of government, including the Harry S Truman State Office Building and the Truman parking lots pursuant to Section 8.1200 RSMo 1978; THEREFORE, be it resolved that the Board of Public Buildings hareby authorizes the Director of the Division of Design and Construction to expend an amount not to exceed Three Hundred Thousand Dollars ($3009000) from the Truman Construction Account for the development of West Main Street in Jefferson City, Missouri. Webster, Attorney General Member, Board of Public Buildings 4704y • ' i �A RESOLUTION NO. 3108 RESOLUTION AUTHORIZING THE CHAIRMAN OF THE BOARD OF COMMISSIONERS OF THE HOUSING AUTHORITY OF THE CITY OF JEFFERSON TO `ENTER INTO AN INTERGOVERNMENTAL COOPERATIVE AGREEMENT BETWEEN THE HOUSING AUTHORITY, THE CITY OF JEFFERSON AND THE STATE OF MISSOURI WHEREAS, the Housing Authority has previously agreed to enter into an Intergovernmental Cooperative Agreement with the City of Jefferson and the State of Missouri; and WHEREAS, ' the Board deems it desirable to approve the form of Intergovernmental Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE HOUSING AUTHORITY OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: 1. The contribution of the Housing Authority is hereby confirmed according to the terms and conditions therein contained, for the amount of $125,000.00; 2. The Chairman is authorized and directed to execute and deliver the Intergovernmental Agreement substantially in the form attached to this Resolution. The Secretary and any Assistant Secretary of the Authority are hereby authorized and directed to attest the Intergovernmental Agreement and any such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this Resolution. 3. The Authority shall, and the officers and agents of the Authority are hereby authorized and directed to, take such action, expend such funds and execute such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this Resolution. He is the duly qualified and acting Secretary and Executive Director of the housing Authority of the City of Jefferson, Missouri, (hereinafter called the "Local Public Agency") , and the custodian of the records of the Local Public Agency, including the minutes of the proceedings of the Board of Commissioners (hereinafter called the "Governing Body") , and is duly authorized to execute this certificate. 2. Attached hereto is, a true and correct copy of a Resolution including the WHEREAS clauses, adopted at a _ Regular Board meeting of the Governing Body held on the 29th. day of September , 1987 '. 3. Said Resolution has been duly recorded in the minutes:of said meeting and is now in full force and effect. 4. Said meeting was duly convened and held in ail respects in accordance with law and the bylaws of the Local Public Agency. To the extent required by law and said bylaws, due and proper notice of said meeting was given. A legal quorum of members of the Governing Body was present throughout said meeting, and a legally sufficient number of members of the Governing Body voted in the proper manner for the adoption of said Resolution. All other requirements and proceedings under applicable law, said bylaws, or otherwise, incident to the proper adoption of said Resolution, including any publication, if required by law, have been duly fulfilled, carried -out, and otherwise observed. 5. If a seal appears below, it constitutes the official seal of the Local Public Agency and was duly affixed by the undersigned at the time this certificate was executed. If no seal appears below, the Local Public Agency does not have and is not legally required to have an official seal. IN WITNESS WHEREOF, the undersigned, has hereunto set his hand this �i day of October 19 87 S k A L Secretary AMENDMENT TO INTERGOVERNMENTAL COOPERATIVE AGREEMENT WHEREAS, an inter-governmental agreement has been signed between the State of Missouri, the City of Jefferson, the Housing Authority of the City of Jefferson, and the Cole County Highway Commission for participation in the new West Main development plans; and WHEREAS, the cost of the project is now known to exceed the original estimates; and WHEREAS, the City of Jefferson, Missouri, the Housing Authority of the City of Jefferson, Missouri, and the Cole County Highway Commission have agreed to share in their portion of the cost for the improvement of West Main Street, and are willing to amend the existing inter-governmental agreement; and WHEREAS, the state's portion of the additional costs in conjunction with the West Main Street project is One Hundred Thousand Dollars ($100, 000) ; and WHEREAS, the Housing Authority's portion of the additional costs in conjunction with the West Main Street project is Ninety Thousand Dollars ($90, 000) ; and WHEREAS, the City of Jefferson's portion of the additional costs in conjunction with the West Main Street project is estimated to be Ninety Thousand Dollars ($90, 000) : NOW, THEREFORE, the parties agree as follows: 1. All terms of the previous agreement and any amendments thereto shall remain in full force and effect and the provisions herein shall be in addition to the terms and amounts of the previous agreement: a. The State shall pay an additional One Hundred Thousand Dollars ($100,000) . Upon the issuance of the Notice to Proceed on the reconstruction of West Main Street from the State Capitol to Bolivar Street, and the installation of the lighting and the utility relocation the sum of $50, 000. 00; upon the project being 50% complete the sum of $25, 000. 00; and upon substantial completion and after inspection and approval, the sum of $25, 000.00. b. The Housing Authority shall pay an additional Ninety Thousand Dollars ($90, 000) . Upon the issuance of the Notice to Proceed on the reconstruction the sum of $54 , 000. 00; upon the project being 50% complete the sum of $18, 000. 00; and upon substantial completion of the utility relocation and landscaping, after inspection and approval the sum of $18,000.00; C. The City agrees it will contribute the portion of the funds not totally provided by the State and Housing Authority. Due to recent changes, it is anticipated to be an additional Ninety Thousand Dollars ($90, 000) . IN TESTIMONY WHEREOF, we have hereunto set our hands this {� day of , 1988 .
