AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH DAVID D. PAVXTT
AND BETTY JO PAVITT FOR THE PURCHASE OF READ ESTATE AT THE
JEFFERSON CITY MEMORIAL AIRPORT.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and Clerk are hereby authorized and
directed to execute an agreement with David D. Pavitt and Betty
Jo Pavitt for the purchase of real estate at the Jefferson City
Memorial Airport for a sum not to exceed $49,000.00.
Section 2. The contract shall be substantially the same in
form and content as that contract attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and affect
from and after the date of its passage and approval,

CONTRACT FOR SALE OF REAL ESTATE

This Contract made and entered into this _iz day of
December, 1987 by and between DAVID D. PAVITT and BETTY JO
PAVITT, husband and wife, of Callaway County, Missouri, Sellers
and THE CITY OF JEFFERSON, MISSOURI, a municipal corporation,
Buyer.
WITNESSETH:
1. That the Sellers agree to sell and the Buyer agrees to
buy upon the following terms and conditions, the real estate
situated in the County of Callaway, State of Missouri.
2. The purchase price is Forty-nine Thousand Dollars
($49,000.00) payable as follows: On the delivery of the deed,
Forty-nine Thousand Dollars ($49,000.00) cash.
3. The consideration for this Contract is that the parties
hereto hereby agree to cancel and for naught hold the Lease
Agreement on -the premises described in Exhibit A attached hereto
dated June 17, 1986 as of the date of this contract and neither
party shall have any rights or liabilities under said Lease
Agreement except that Buyer shall pay to Sellers the rent due
under said agreement for the month of October, 1987.
4. Buyer may continue in possession of the premises from
the date of this contract until date of closing.
5. Merchantable title of record and in fact shall be
conveyed by warranty deed free and clear of all encumbrances
except as herein provided.
6.. Sellers shall within a reasonable time hereof deliver to
the Buyer an abstract of title to said premises, prepared and
certified to date by a competent abstracter and showing
merchantable title of record in Sellers. Buyer shall have 10
days from receipt of the abstract to deliver to Sellers in
writing any objections to title, and any objections to defects
appearing in the abstract not so made, except liens of record,
shall be deemed waived. Any defects in title shall be corrected
by the Sellers within a reasonable time from receipt of notice of
such defects, provided that if such defects can not be corrected
within said time, then this contract shall be void and the money
paid by the Buyer herewith shall be returned to it and the
abstract to the Sellers.
7. Taxes for the year 1987 shall be paid by Sellers.
Sellers shall pay the real estate taxes for the year of 1988 only
up to the date of the delivery of the deed. Any special
assessments becoming a lien after the date. ..hereof shall be paid
by the Buyer.
8. This transaction shall be closed on the � day of
January, 1988, at the Jefferson City Municipal Building, or at
any other time or place agreed to between Buyer and Sellers, at
which time all money and papers shall be delivered and
transferred and absolute possession of the property shall be
delivered to the Buyer.
9. in the event of any loss or damage -to said premises
between the date of this contract and the delivery of the deed,
the Buyer shall receive all insurance payable for the same,
provided however, that if said damage is substantial and
materially affects the present use of the property, then the
Buyer at its election may rescind this contract and the Sellers
QP shall be entitled to any insurance payable for same.
l®. This contract shall be binding upon the heirs,
administrators, successors and assigns of the parties hereto.
In Witness Whereof, the parties hereto have subscribed their
names in duplicate, the day and year first above written.
