HomeMy Public PortalAboutORD10954 BILL NO. 87-145 SPONSORED BY COUNCILMAN BARNICL ORDINANCE NO. 40 9115-V AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING ORDINANCE NO. 9598, THE ZONING ORDINANCE, BY DELETING SECTION 10A(5 ) (c ) PERTAINING TO VARIATIONS, AND BY ENACTING A NEW SECTION RELATING TO THE SAME SUBJECT. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI , AS FOLLOWS: Section 1. Ordinance No. 9598 , the Zoning Ordinance, is hereby amended by deleting Section 10A( 5 ) (c) and enacting in lieu thereof one new section to read as follows: (c) To permit the following three variations : (c. l) Vary the yard regulations where there is an exceptional or unusual physical condition of a lot, which condition is not generally prevalent in the neighborhood and which condition when related to the yard regulations of this ordinance would prevent a reasonable or sensible arrangement of buildings on the lot. (c.2 ) Vary the parking regulations where an applicant demonstrates conclusively that the specific: use of a building would make unnecessary the parking spaces required by this ordinance, but providing that such reduction not be more than 50% of the usual requirement. (c.3 ) Vary the provisions of Section 4B( 1 ) to allow accessory buildings to contain a maximum of 1 , 500 square feet. In exercising this authority, the Board may impose conditions and shall find the following: (c.3 .a) The accessory building will be located on a lot containing four or more acres . (c.3 .b) The accessory building will be used to house the owner' s personal vehicles . ( c.3 .c) The accessory building will be located in the rear yard, will be at least 50 feet from all side and rear lot lines and will be at least 250 feet from any public street. ( c.3 .d) The building materials used on the building will blend in with the landscape and minimize the visual impact of the structure . -2- (c.3.e ) In granting, under this subsection, a variance, the Board may impose such conditions upon the premises receiving the variance as may be necessary to insure that the variance will not: ( i. ) Be unduly injurious to the use and enjoyment of other property in the immediate vicinity. ( ii. ) Have a significant adverse affect on property values in the neighborhood. ( iii. ) Be detrimental to nor endanger the public health, safety or general welfare of the citizens of the city. Section 2 . This ordinance shall be in full force and effect from and after its passage and approval. Passed: �zr �`!�''� Approved:� ?I /tr-17 e Si ng cer a ATTEST: ' 'Pity Cle.rk f STAFF REPORT PUBLIC HEARING ON A CHANGE TO THE ZONING TEXT RE: A proposed amendment to Section 10A ( 5 ) (c ) of the Zoning Ordinance. This amendment would add variance provisions related to accessory buildings. The subsection of the Zoning Ordinance which specifies they size of accessory buildings currently reads as follows: "A private residential garage used only for the housing of non-commercial passenger automobiles and with a floor area not to exceed 450 square feet . An additional floor area of 200 square feet may be provided for each 3, 000 square feet of lot area by which such lot exceeds 6,000 square feet , provided no garage shall exceed 1,000 square feet nor house more than five such automobiles. " There are no exception or variance provisions. The proposed amendment provides a variance provision which allows the Board of Adjustment to authorize an accessory building to contain a maximum of 1 , 500 square feet after making certain findings . These findings are : the accessory building (a) will be on a lot of four or more acres , (b) will be used to house the owner° s personal vehicles , (c) will be in a rear yard, be at least 50 feet from property lines and at least 250 feet from a public street, and (d) the building materials used will minimize the visual impact of the structure. The amendment also authorizes the Board to impose conditions on the accessory building. The proposed amendment was reviewed by the Board of Adjustment on October 13, 1987 . The Planning and Zoning Commission, on October 8, 1987, voted unanimously to recommend that this proposed amendment be adopted. D. R. Preston City Planner October, 1987
