AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT IF NEEDED, WITH UNION ELECTRIC COMPANY FOR THE RELOCATION OF OVERHEAD ELECTRICAL LINES AS IT PERTAINS TO IMPROVEMENTS FOR WEST MAIN STREET AND AUTHORIZING PAYMENT FOR THE RELOCATION. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized to execute an agreement with Union Electric Company for the relocation of overhead electrical lines as it pertains to improvements for West Main Street, if needed. The amount of the agreement is not to exceed $189,000.00. Section 2. The Finance Department is hereby authorized to pay such sums as are required for the relocation of utilities, either pursuant to an agreement as set forth in Section 1, or upon duly submitted and approved invoices, provided the total of such payments does not exceed $189,000.00. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed / !�'� Approved � .ct 9'� f i c e r ATTEST: City Clerk West Main Street Jefferson City Cole County, Missouri UTILITY AGREEMENT THIS AGREEMENT entered into by and between UNION ELECTRIC COMPANY, a corporation existing under the laws of the State of Missouri, with its address at 1901 Gratiot Street, St. Louis, Missouri, hereinafter called 'CCompany", and the City of Jefferson, Missouri, hereinafter called "City", WITNESSETH THAT: WHEREAS, City proposes to construct and improve a section of city street designated as West Main Street between Broadway Street and Clay Street, Jefferson City, Cole County, Missouri, in accordance with sketch attached hereto and marked Exhibit "A". WHEREAS, to improve said street in accordance with said sketch it will be necessary to adjust certain facilities now located along said street in order to maintain the present services of said Company, such changes being generally shown on sketch marked Exhibit "A", the cost of which is set out in Mr. Larry Rushing.'s letter dated December 8,' 190, to Mr. Mike Bates and marked Exhibit "B" attached hereto and each made a part hereof. NOW, THEREFORE, in consideration of the mutual covenants contained herein, ,it is agreed as follows: 1. City will .furnish to Company all necessary information on the street construction,. improvement, reconstruction, and maintenance in order to enable Company to properly carry out adjustment of its facilities. 2. If any substantial change is made in the original plan and extent of the work, Company agrees that an adjustment of City's Obligation as 'set out in Paragraph 5 will be made by supplemental agreement or change order approved by the City Mayor PRIOR to the performance of the work. 3. Upon completion of the work provided herein, Company shall remove all leftover materials and debris resulting from the work and leave the right of way in a neat, workmanlike condition, free of holes, 1 mounds of dirt, or other objectionable material. , i 0 } { i 4. At all times when work is being performed by Company under such conditions as will affect traffic on the public street, Company will display warning signs, barricades, flags, light and/or flares as circum- stances may require and shall employ and use a flagman when required for safety to the traveling. public. 5. The total charge for the work required for the street construc- tion is estimated to be $188,873. It is agreed, prior to commencement of the work in accordance with said sketch (Exhibit A) and letter i (Exhibit B) , that City will reimburse Company in the amount of $188,873. We have proceeded with this project and we are pleased with its progress. Aft We have submitted a $22 , 000 check to the Railroad for the license to locate our facilities on Railroad prcperty. Also, we will soon be performing soil tests for the design and construction of the concrete foundations to support the tubular steel poles to be utilized in the project. We must promptly order the steel poles for this project that we might accommodate the City's construction requirements. We are currently incurring the additional costs to locate the circuits to the Railroad right-of-way. Our estimated cost to relocate our facilities to the new right- of-way, line on West Main Street was $196, 127. Our estimated cost to relocate these facilities north to the Railroad property and to utilize steel poles in the construction was $385, 000. Consistent with the terms of our franchise, the City and/or State government would be responsible for the difference in cost between relocating our facilities to West Main Street right-of- way and relocating our facilities to the Railroad property. The difference in cost is $188 , 873 . Please consider this letter our formal request for payment of these additional costs of $188, 873 .
