Section 1. Ordinance 10787 pertaining to the Rules and Regulations for the Police Personnel Board is hereby repealed. Section 2. The document entitled "Rules and Regulations of the Jefferson City Police Personnel Board" , dated February 12, 1988, designated as Exhibit "A" and attached hereto, is hereby adopted as the official personnel rules and regulations for the Police Personnel Board of the City of Jefferson. Section 3. This Ordinance shall be in full force and effect from and after its date of passage and approval. Passed 2� 2/, / Approved �.1••�5j :.' siding fiver ayor ATTEST: A City Clerk RULES AND REGULATIONS OF THE JEFFERSON CITY POLICE PERSONNEL BOARD Pursuant to the authority of Section 24-48 of the Code of the City of Jefferson, Missouri, the Police Personnel Board hereby adopts the following Rules and Regulations governing its operation. ' Adopted by Board: Fe bru arch ® RULE 1 : OFFICERS The Board shall elect from its members a chairman , vice-chairman, and secretary. The chairman shall preside over all meetings of the Board and shall act as the official spokesperson for the board. The vice-chairman shall act on behalf of the chairman in all instances when the chairman is not in attendance at any meeting of the Board or is otherwise unable to perform his or her duties. The secretary shall keep all records of the Board, including recording minutes of all Board meetings . Officers shall serve one-year terms and shall serve until a successor is duly elected and qualified. Officers shall be elected at the first meeting in January of each year. Officers shall assume their respective duties immediately upon ® election. RULE 2 : MEETINGS Meetings shall be held the first Thursday of every month and at such other times as are necessary for the Board to operate efficiently. Board meetings shall commence at 7 :30 a.m. or at such other time as the Board may agree. RULE 3 : QUORUM At least four members of the Board must be present at the beginning of a meeting in order for a quorum to be deemed present. RULE 4 : MAJORITY VOTE . A majority vote of those members present at any meeting at which a quorum is present shall be required to pass any issue presented to the Board. ® RULE 5: FREQUENCY OF EXAMINATIONS Examinations for police officer and communications officer shall be conducted once yearly the third Saturday in August. Examinations for police officer and communications officer may be conducted at other times if the Board determines that additional examinations are necessary in order for eligibility lists to be supplemented. Examinations for establishment of promotional registers or other employee registers shall be held at such times as the Board is notified by the Mayor or Chief of Police of the need for supplementation of such registers. RULE 6: EXAMINATIONS Examinations for establishment of eligibility or promotional AM registers shall consist of open, competitive written and oral examinations and may include skill tests , such as typing, shorthand, etc. Such examinations shall be designed to determine objectively the relative qualifications of applicants for employment or promotion. The Board is authorized to delegate testing of skill levels to public or private testing agencies. RULE 7: NOTIFICATION OF EXAMINATIONS The Board shall give public notice of each open, competitive employment and promotional examination by publishing the same in a newspaper of general circulation in the City of Jefferson, first publication being a minimum of fifteen (15) days prior to the written examination. The notice shall be published a minimum of three times per week for two weeks. The Board shall give such other notice as it deems necessary, including the posting of notice of promotional examinations in the Police Department Building. ® RULE 8: COMPLETION OF APPLICATION Any person desiring to participate in any employment or promotional examination shall complete an application therefor on a form to be provided by the Board. Failure to complete fully an application shall result in the applicant being refused permission to participate in any testing. Applications for admission to examinations must be received in the City Clerk' s office no later than ninety-six (96) hours prior to the commencement of examination. RULE 9 : ADMISSION TO EXAMINATIONS Prior to admission to any examination, applicants shall furnish positive proof of identification. Only persons who have submitted timely applications as provided in Rule 8 shall be admitted to the examination. RULE 10 : WAIVER OF CERTAIN RULES The Board, in its discretion, for good cause shown, may allow an applicant for employment or promotion to take the written examination at a time other than that scheduled. In the event an applicant is permitted to take an examination at other than the published time, the Board shall impose such conditions as will insure that the contents of the examination are kept strictly confidential. RULE 11 . DISQUALIFICATION FOR DECEPTION The board may reject the application of any person and may • terminate any further processing of an application if it finds that the applicant has knowingly made a false statement of fact in his or her application or has attempted to practice any fraud ® or deception in his or her application or examination. In the event the Board rejects an application or terminates its further processing as provided herein, the Board shall immediately notify the applicant in writing of such rejection or termination together with the reasons therefor. RULE 12: ORAL EXAMINATION The Board shall conduct oral examinations of all persons achieving a passing grade on the written examination, said oral examination being designed to test objectively the relative qualification of applicant. RULE 13 : ESTABLISHMENT OF PASSING GRADE In order for an applicant' s name to be placed upon an eligibility or promotional register, the applicant must obtain a minimum score of 80 on both the written and oral examination, said score to be based upon a scale of from 0 to 100. RULE 14: RATING OF EXAMINATIONS The written and oral examinations shall each constitute fifty percent (50%) of applicant' s final rating. RULE 15 : VETERAN' S PREFERENCE An honorably discharged veteran of any branch of service in the armed forces of the United States , who has met all other requirements for eligibility, shall be given an additional credit of five (5) point on his or her oral examination score. ® RULE 16: CREDIT FOR EXPERIENCE Any presently certified peace officer as defined in Chapter 590 of the Revised Statutes of Missouri, who has met all other requirements for eligibility, shall be given an additional credit of five (5) point on his or her oral examination score. RULE 17 : ADDITIONAL CREDIT LIMITATIONS Rules 16 and 17 shall not apply in the establishment of promotional registers. RULE 18: NOTIFICATION OF RESULTS Every person completing an examination shall be notified within forty-five (45) days whether he or she passed or failed the examination. ® RULE 19 : APPLICANT MUST PASS WRITTEN AND ORAL EXAM In order for an applicant' s name to be placed upon an employment or promotional register, the applicant must pass both the written and oral examinations and further must meet any minimum skill level established by the Board. RULE 20: REGISTERS A single register shall be maintained by the Board for each of the following positions: 1. Administrative Secretary 2. All other civilian employees 3 . Police Reserve Officer 4 . Police Officer 5 . Communications Officer 6. Sergeant 7 . Lieutenant 8. Captain 9. Chief of Police An applicant' s name, once placed on the register, shall remain on the register for one (1) year. At the expiration of said year, such applicant' s name shall be removed from the applicable register. Registers shall be maintained in alphabetical order and test scores shall be recorded beside the name of each person on each register. Test scores shall be reported on registers by listing (1) written examination scores ; (2) oral examination scores; and (3) total scores . RULE 21 : BOARD MEMBERS AT TESTS At least two (2) members of the Board shall be present for supervision of written examinations. At lease four (4) members shall be present to conduct oral examination. RULE 22: RULES SUBJECT TO TEMPORARY SUSPENSION If the Board finds that an emergency exists requiring suspension of some or all of the above rules for a temporary period, such rules may be suspended upon approval of such suspension by the City Council. RULE 23 : APPEALS Any member of the Police Department who is demoted, suspended, or discharged may appeal in writing to the Board, within thirty (30) days after the effective date of such action, • setting forth his or her reasons for claiming his demotion, suspension or discharge was not for good cause or for the good of the department. Upon such action the Board shall within ten (10) days hear the appeal, and the appellant, chief of police, and the appointing authority shall have the right to be heard in person, to be represented by counsel and to present evidence at such hearing, which shall be a public hearing at the request of appellant. Technical rules of evidence shall not apply at such hearing. Upon consideration of the evidence and within fifteen (15) days of the conclusion of the hearing, the Board shall approve or disapprove the action appealed from, and in the event of disapproval, the Board shall order the appellant reinstated to his former position and payment of such salary as was lost to the appellant by reason of such demotion, suspension or discharge. Any disciplinary' action shall not be stayed by virtue of an appeal to the Board. All proceedings at a hearing as provided herein shall be duly recorded by stenographic or electronic recording. RULE 24 : AMENDMENT OF RULES These rules may be amended by majority vote of the Board at any meeting at which a quorum is present, which amendments are not effective until approved by the City Council.
