ORDINANCE NO. 1106,3
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING THE RIGHT-OF-WAY FOR A PORTION OF A RESERVED TRACT
IN WALINKO PLACE SUBDIVISION IN THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, the portion of a reserved tract in Walinko Place
Subdivision described below has never been opened; and
WHEREAS, it has been shown to the City Council of the City
of Jefferson, Missouri, that the owner of land adjacent to and
abutting this tract, more particularly described as follows:
Part of a Reserved Tract of Walinko Place Subdivision, in
the City of Jefferson, Missouri, as per plat of record in
Plat Book 2, Page 59, Cole County Recorder's Office, more
particularly described as follows:
From the northeast corner of Lot 24 of Block A of said
Walinko Place Subdivision; thence N 09 0301451' E, along the
westerly line of a 30 foot unnamed street, 373.67 feet to
the point of beginning for this description and being the
beginning of a 40 foot radius shown on a survey for
Hayselton Drive recorded in Plat Book 3, Page 65, Cole
County Recorder' s Office; thence continuing N 09 030145" E,
along the westerly line of said 30 foot unnamed street,
76.84 feet to the southerly line of a 60 foot right-of-way
for Hayselton Drive as shown on said survey in Plat Book 3,
Page 65; thence southwesterly along the southerly line of
said 60 foot right-of-way on a curve to the left, having a
radius of 491.02 feet, a distance of 80.26 feet to a point
of intersection with the aforesaid 40 foot radius shown in
said Plat Book 3, Page 65; thence in an easterly and
southerly direction along said 40 foot radius, 90. 60 feet to
the point of beginning.
WHEREAS, it has further been shown that it would not
inconvenience the public or the citizens of the City to
discontinue such right-of-way for public use as described in
Section 1 of this Ordinance, subject to a reservation in the City
of an easement in that portion vacated for the maintenance,
repair, location and relocation of all sanitary sewer, surface
water sewer or public utility facilities now existing or
hereafter to be constructed within said right-of-way;
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri,
hereby declares it necessary, reasonable and proper to
discontinue as a right-of-way for a public street and forever
® vacate the following described street right-of-way, subject to
the reservation in the City of the easement mentioned in Section
2 of this Ordinance:
Part of a Reserved Tract of Walinko Place Subdivision, in
the City of Jefferson, Missouri, as per plat of record in
Plat Book 2, Page 59, Cole County Recorder's Office, more
particularly described as follows:
From the northeast corner of Lot 24 of Block A of said

Section 2. The statutory right of reversion in the owners
of the abutting property is hereby confirmed, subject to the
easement expressly reserved in Section 2 of this Ordinance, as is
provided by the laws of the State of Missouri, and the Mayor and
the Clerk of the City are hereby authorized to execute all
necessary instruments required to confirm the reversionary rights
of the owners of property abutting on the area vacated, as
described in Section 1 of this ordinance, in the right-of-way
vacated.
Section 3. This ordinance shall be in full force and effect
from and )after its passage and approval.
