AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1152-09 AND THE FISCAL YEAR 2009-10 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 1152-09 on September 8, 2010, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2009-10; and WHEREAS, changed conditions and circumstances which could not have been foreseen through the use of reasonable diligent thought and attention, necessitated the adoption of Ordinance No. 1173-10 on June 8, 2010 and Ordinance No. 1177-10 on September 14, 2010 amending the budget adopted by Ordinance No. 1152-09; and WHEREAS, a public hearing on the following amendment to the fiscal year 2009-10 budget contemplated has been held as required by law. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section VI of said Ordinance No. 1152-09 as amended be amended appropriating $290,135 out of the 1998 Certificate Obligations Interest and Sinking Fund for the repayment of wastewater works long term debt principal and interest. II. That Section VII of said Ordinance No. 1152-09 as amended be amended appropriating $66,505 out of the 2005 Contractual Obligation Interest and Sinking Fund for the repayment of long term principal and interest. III. That Section X of said Ordinance No. 1152-09 as amended be amended appropriating $49,831 out of the 2007 Contractual Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. IV. That Section XI of said Ordinance No. 1152-09 as amended be amended appropriating $286,897 out of the Drainage Utility Fund for drainage system improvements in accordance with City's drainage ordinance and state law. V. That Section XIII of said Ordinance No. 1152-09 as amended be amended appropriating $253,782 out of the Road and Street Improvement Fund for capital outlays in conjunction with street improvements. VI. That Section XIV of said Ordinance No. 1152-09 as amended be amended appropriating $10,285 out of the Municipal Court Technology fund for the purpose of capital equipment and assets. VII. That Section XV of said Ordinance No. 1152-09 as amended be amended appropriating $126,951 out of the 2001 Certificate Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. VIII. That Section XIX of said Ordinance No. 1152-09 as amended be amended appropriating $506,925 out of the Crime Control and Prevention District Expense Fund for the purpose of acquiring capital assets and equipment and supporting crime reduction programs throughout the City. Ix. That Section XXI of said Ordinance No. 1152-09 as amended be amended appropriating $180,307 out of the Capital Project Enterprise and General Funds for the purpose of constructing water facility improvements and purchase of vehicles and equipment. X. That Section XXVI of said Ordinance No. 1152-09 as amended be amended appropriating $426,858 out of the Traffic Safety Fund for the purpose of constructing traffic quieting pavement improvements, crash construction equipment and payment of fees to the State of Texas. XI. That Section XXVII of said Ordinance No. 1152-09 as amended be amended appropriating $585,922 out of the 2007 Waterworks Bond Issue Expense Fund for the purpose of constructing improvements to the water and wastewater system. XII. That Section XXVIII of said Ordinance No. 1152-09 as amended be amended appropriating $58,265 out of the Electronic Meter Reading Lease Purchase Expense Fund for the purpose of repaying long term debt. XIII. That Section XXIX of said Ordinance No. 1152-09 as amended be amended appropriating $35,599 out of the School Resource Officer Fund for the purpose of providing police services to the school district. XIV. That Section XXIX-A be created in said Ordinance No. 1152-09 as amended be amended appropriating $15,240 out of the Facilities Improvement Fund for the purpose of constructing fire administration offices and installing air conditioning unit atop the old police station building. XV. That Section XXIX-B be created in said Ordinance No. 1152-09 as amended be amended appropriating $8,239 out of the Library Grants TIF Fund for the purchase of computers and equipment for the Library. XVI. That Section XXIX-C be created in said Ordinance No. 1152-09 as amended be amended appropriating $260 out of the Law Enforcement Fund to purchase equipment for the Police Department. XVII. That Section XXIX-D of said Ordinance No. 1152-09 as amended be amended appropriating $168,644 out of the TOD THE Grant Expense Fund for the construction of sidewalks connecting to the THE Station. XVIII. That Section XXIX-E be created in said Ordinance No. 1152-09 as amended be amended appropriating $150,000 out of the 2010 Drainage Bond Expense Fund for the purpose of constructing capital improvements to the drainage system. XIX. That Section XXIX-F be created in said Ordinance No. 1152-09 as amended be amended appropriating $140 out of the 2010 Drainage Bond Interest and Sinking Fund for the purpose of paying long term debt. XX. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XXI. Saving Clause. That said ordinance No. 1152-09 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. XXII. Effective Date. This ordinance shall be in full force and effective from and after its passage. XXIII.
