HomeMy Public PortalAboutORD11044 BILL NO. 88-15 AMENDED ® SPONSORED BY COUNCILMAN MASON ORDINANCE NO. // % C AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, PROHIBITING THE OUTDOOR DISPLAY AND STORAGE OF TIRES. WHEREAS, this City Council believes that the outdoor storage of tires can result in the creation of dangers to the public health, safety and welfare of the citizens of Jefferson City; and, WHEREAS, the outdoor storage of tires should be regulated in order to limit potential dangers to the public health, safety and welfare of the citizens of the City; WHEREAS, the Aedes albopictus (Asian tiger) mosquito has been recognized as a serious and growing threat to public health because of its feeding habits, disease transmitting capabilities, and rapid increasing numbers throughout the Midwest; and, WHEREAS, new and used tires constitute one of the most significant breeding sites and methods of spreading infestation; NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF JEFFERSON CITY, MISSOURI, AS FOLLOWS: Section 1. That no person, firm or corporation shall store or display new or used tires outside of a building. Section 2. That any person, firm or corporation who violates any section of this ordinance shall be guilty of a misdemeanor. Section 3. The only exception to the outdoor storage prohibition set out above shall be as follows: a) Licensed business may display tires during normal working hours for advertisement purposes. Tires must be covered in such a way as to prevent them from holding water. b) Tires may be used as play ground equipment provided that any such tires shall have been rendered incapable of holding water. Section 4. That this ordinance be declared an emergency measure in the interest of the public health, welfare and safety and for the further reason that the improper outdoor storage of tires within the City creates conditions hazardous to the safety and health of the inhabitants of the City and it is necessary to correct said conditions at the earliest possible time, and this ordinance shall be in full force and effect upon the date of its passage and approval provided that any person, firm or corporation who operates a business dealing with tires who currently stores tires on the exterior of his, her or its building shall have until July 1, 1988, to comply with the provisions of this ordinance.
