HomeMy Public PortalAboutORD11060 BILL NO. 88-35 SPONSORED BY COUNCILMAN -HA� SEY ORDINANCE NO. //66 D AN ORDINANCE OF THE CITY OF JEFFERSON, MI;:-'•:iDURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE INTRAGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF JEFFERSON, THE HOUSING AUTHORITY AND THE STATE OF MISSOURI, FOR WORK ON THE WEST MAIN STREET PROJECT. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are authorized to execute an amendment to the Intragovernmental Agreement between the City of Jefferson, The Housing Authority and the State of Missouri, for work on the West Main Street Bridge Project. Section 2. The amendment shall be substantially the same as that attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. AP/mcj w t ® AMENDMENT TO INTERGOVERNMENTAL COOPERATIVE AGREEMENT WHEREAS, an inter-governmental agreement has been signed between the State of Missouri, the City of Jefferson, the Housing Authority of the City of Jefferson, and the Cole County Highway Commission for participation in the new West Main development plans; and WHEREAS, the cost of the project is now known to exceed the original estimates; and WHEREAS, the City of Jefferson, Missouri, the Housing Authority of the City of Jefferson, Missouri, and the Cole County Highway Commission have agreed to share in their portion of the cost for the improvement of West Main Street, and are willing to amend the existing inter-governmental agreement; and WHEREAS, the state's portion of the additional costs in conjunction with the West Main Street project is One Hundred Thousand Dollars ($100,000); and WHEREAS, the Housing Authority's portion of the additional costs in conjunction with the West Main Street project is Ninety Thousand Dollars ($90,000) ; and WHEREAS, the City of Jefferson's portion of the additional costs in conjunction with the West Main Street project is estimated to be Ninety Thousand Dollars ($90,000) : NOW, THEREFORE, the parties agree as follows: 1. All terms of the previous agreement and any amendments thereto shall remain in full force and effect and the provisions herein shall be in addition to the terms and amounts of the previous agreement: a. The State shall pay an additional One Hundred Thousand Dollars ($100,000) . Upon the issuance of the Notice to Proceed on the reconstruction of West Main Street from the State Capitol to Bolivar Street, and the installation of the lighting and the utility relocation the sum of $50,000.00; upon the project being 50% complete the sum of $25,000.00; and upon substantial completion and after inspection and approval, the sum of $25,000.00. b. The Housing Authority shall pay an additional Ninety Thousand Dollars ($90,000) . Upon the issuance of the Notice to Proceed on the reconstruction the sum of $54,000.00; upon the project being 50% complete the sum of $18,000.00; and upon substantial completion of the utility relocation and landscaping, after inspection and approval the sum of $18,000.00; dr C. The City agrees it will contribute the portion of the funds not totally provided by the State and Housing Authority. Due to recent changes, it is anticipated to be an additional Ninety Thousand Dollars ($90,000) . IN TESTIi� WHEREOF, we have hereunto set our hands this day of f , 1988. Cook, Chairman Board of Commissioners ATTEST: r Executive Director Secretary, Board of Commissioners RESOLUTIOX OF THS BOARD OF PUBLIC BUILDINGS WHEREAS, the Board of Public Buildings is responsible for all facilities and improvements at the Capitol Complex pursuant to Section 8.010, RSMo, 19781 and, WHEREAS, the General Assembly of Missouri has appropriated funds to the Office of Adminstration for the Division of Design and Construction In House Bill 17, 83rd General Assembly, First Regular Session, for parking facilities for the Capitol Complex; and, WHEREAS, a new parking garage is presently being constructed on West Main Street, adjacent to the Cao tol Building; and, • WHEREAS, sidewalks, street 'pavement, street lighting, and utilities on the state land where the parking garage is located, need to be provided and/or revised to accommodate the city's new West Main development plans; and, WHEREAS, an inter-governmental agreement has been signed between the State of Missouri, the City of Jefferson, the Housing Authority of the City of Jefferson, and the Cole County Highway Commission for participation in the new West Main development plans; and, WHEREAS, the City of Jefferson, Missouri, the Housing Authority of f� the City of Jefferson, Missouri, and the Cole County Highway Commission have agreed to share in their portion of the cost for the proposed development of West Main Street, and are willing to amend the existing inter-governmental agreement; and, WHEREAS, the state's portion of the development costs in conjunction with the new parking garage along West Main Street is One Hundred Thousand Dollars ($100,000); and, WHEREAS, the Director of the Division of Design and Construction is responsible for the construction of all facilities and improvements at the Capitol Complex pursuant to Section 8.1100 RSMo, ,1978; NOW THEREFORE, be it resolved that the Board of Public Buildings . hereby authorizes the Director of the Division of Design and Construction to amend the existing inter-governmental agreement, and to expend an amount not-to-exceed One Hundred Thousand Dollars ($100,000) from the account established for Section 17.145 of the Conference Committee Substitute for House Bill 17, 83rd General Assembly, First Regular Session, for the development of West Main Street in Jefferson City, Missouri.
